The death penalty has been abolished for nine offenses.

The 2015 Penal Code, amended and supplemented in 2017, will take effect from January 1, 2018, but according to Resolution 144, the provisions (for offenders from July 1, 2016) will apply. Specifically, the death penalty will be abolished for the following nine crimes:

(This crime has been abolished, and therefore the death penalty for this crime has also been abolished.)

2. The crime of robbery (Article 168)

3. The crime of surrendering to the enemy (Article 399)

4. The crime of disobeying orders(Article 394)

5.Crime of destroying structures, facilities, and equipment important to national security (Article 303)

6. The crime of possessing, transporting, buying, selling, or appropriating precursor chemicals used in the illegal production of narcotics (Article 253)

7. Crime of producing and trading counterfeit food, food additives (Article 193)

8. The crime of embezzlement of property (Article 353)

(Abolish the death penalty for cases where, after being sentenced to death, the individual voluntarily returns at least three-quarters of the embezzled or bribed assets and actively cooperates with authorities in detecting, investigating, and prosecuting crimes or performs a significant meritorious service.)

9. The crime of accepting bribes (Article 354)

(Abolish the death penalty for cases where, after being sentenced to death, the individual voluntarily returns at least three-quarters of the embezzled or bribed assets and actively cooperates with authorities in detecting, investigating, and prosecuting crimes or performs a significant meritorious service.)
