Not only was the Ky Anh Urban Environmental Management and Construction Consulting Joint Stock Company discovered to have illegally received and buried hundreds of tons of waste from Formosa, causing widespread public outrage, but prior to that, it also sold the waste that Formosa had hired it to transport to local residents for profit.

Specifically, on May 15, 2015, according to a previously signed contract with MCC5, a subcontractor of Formosa, Ky Anh Urban Environmental Management Construction Consulting Joint Stock Company transported over 4 tons of waste wood. The contract stipulated that all waste from the Formosa construction site must be transported by Ky Anh Urban Environmental Management Construction Consulting Joint Stock Company to a designated disposal site licensed by Vietnamese authorities for processing.

However, immediately after receiving the waste and leaving the Formosa construction site, Mr. Le Quang Hoa, the company's director, instructed his employees to divide the waste into two lots and sell them to the public. The first lot, weighing 1.9 tons, was successfully sold by KA Environmental Company to Mr. Nguyen Xuan Thanh in Ky Phuong ward, Ky Anh town. The second lot, weighing 2.1 tons, was sold by Ky Anh Urban Environmental Management and Construction Consulting Joint Stock Company to another household in Ky Thinh ward.

Upon receiving reports of the aforementioned incident, the environmental safety department of Formosa Ha Tinh Hung Nghiep Company launched an investigation. Following the information provided, Formosa's environmental safety department located the batch of waste that Mr. Hoa had instructed his employees to sell to local residents under breach of contract.

When invited to work with Formosa, Mr. Hoa initially prevaricated and made excuses. However, faced with the evidence presented by Formosa, the director had to admit his wrongdoing. Nevertheless, in the minutes of the subsequent meeting, this "reckless" director claimed that, out of tiếc for the waste that could still be used, he had instructed his employees to sell it to local people for cooking.

Formosa immediately forced Mr. Hoa to retrieve all of the aforementioned waste and imposed a series of penalties on the company, including fines for breach of contract and a ban on the driver and vehicle that transported the waste entering the Formosa construction site. In addition, Formosa required Mr. Hoa's company to ensure that all waste transport vehicles had photographic evidence proving that the waste was dumped in the designated location.

However, once again, Mr. Hoa ignored the regulations, leading to the illegal burial of over 100 tons of sludge, which was recently caught red-handed by the press and authorities, causing a sensation in recent days.

Over the past few days, reporters have continued to investigate the violations committed by the Director of Ky Anh Urban Environmental Management and Construction Consulting Joint Stock Company in illegally receiving and burying Formosa's waste on his family's farm. In numerous interviews with the press and authorities, Mr. Hoa repeatedly stated that he had transferred the land to his brother, Le Van Hanh. However, local authorities stated that this transfer was not officially certified by the government.

Mr. Tran Anh Dan, Chairman of the People's Committee of Ky Trinh Ward, Ky Anh Town, confirmed that Mr. Hoa's waste disposal farm does not have legal documents. According to Mr. Dan, this land was previously reclaimed by local people, and then sold to Mr. Le Quang Hoa by a man named Tuan. Mr. Hoa's claim that he transferred the farm to his brother without going through the local authorities means that, legally, the state has not officially granted or recognized the transfer.

Currently, while awaiting the results of the sludge sample analysis from the Ministry of Natural Resources and Environment, the People's Committee of Ha Tinh province has requested that relevant authorities maintain the current state of the waste disposal area to continue investigating and clarifying the violations of both Formosa and Ky Anh Urban Environmental Management Construction Consulting Joint Stock Company.
