On May 16, the Investigation Police Agency of Hung Yen Provincial Police issued a Decision to prosecute the criminal case, prosecute the accused and issue an Arrest Warrant to detain Nguyen Van Phuong (born in 1965, residing in Van Phuong village, Lien Phuong commune, Hung Yen city, Hung Yen province) for the crimes of Disturbing public order and Resisting a person on duty.

Previously, at around 4:00 p.m. on May 14, Nguyen Van Phuong was driving a car with license plate 89A-325.30 on an inter-village road in Van Phuong village. When arriving at the construction site where the river embankment was being built, Phuong stopped the car, got out, and asked the construction team to move the concrete pouring vehicle on the side of the road so that Phuong could pass.
Seeing that, Mr. Tran Dinh Quyet, the construction supervisor, came out to discuss and suggested Phuong wait or go back to another route to create conditions for the construction workers; but Phuong did not agree, leading to a scuffle between the two sides. During the scuffle, Phuong used her hand to slap Mr. Quyet.
Upon receiving the news of the incident, the Lien Phuong Commune Police working group arrived at the scene. The working group asked Phuong to reverse the car away from the parking spot to allow other vehicles to pass, avoiding congestion and obstruction of traffic, but Phuong did not comply. While the working group was making a record of the incident, Phuong continued to raise her voice and used her cell phone to record the working group.
Captain Nguyen Van Tung, an officer of Lien Phuong Commune Police, asked Phuong to stop shouting and using his phone to record. However, Phuong did not comply and verbally insulted and offended Comrade Tung and the Lien Phuong Commune Police working group.
Based on documents and evidence in the file, the Investigation Police Agency of Hung Yen Provincial Police determined that Nguyen Van Phuong's actions constituted the crimes of Disturbing Public Order and Resisting Law Enforcement Officers.
