Ministry of Justice adds 'spokesperson'

In early July, the Ministry of Justice announced Decision 1431/QD-BTP on the regulations on speaking and providing information to the press. This time, the regulations on speaking have been expanded, clearly defining the responsibility of providing information to the press for a number of positions that are allowed to speak.

According to this Decision, the Director General of the General Department of Civil Judgment Enforcement, the Director of the Department of Inspection of Legal Normative Documents, the Director of the Department of Administrative Procedure Control, the Director of the Department of Management of Handling of Administrative Violations and Monitoring of Law Enforcement, and the Principal of Hanoi Law University under the Ministry of Justice shall proactively provide information to the press on professional activities in each specialized field assigned to them or within the scope and in accordance with the nature of the assigned tasks (for Hanoi Law University).

In addition, at the local level, the Director of the Civil Judgment Enforcement Agency of a province or centrally-run city is the Spokesperson and information provider for the press of the Civil Judgment Enforcement Agency in each province or centrally-run city.

In case of necessity, the Director of the Civil Judgment Enforcement Agency shall authorize another responsible person of the Agency or the Head of the Civil Judgment Enforcement Sub-Department at the district level (hereinafter referred to as the Authorized Spokesperson of the Civil Judgment Enforcement Agency in each province or centrally-run city) to speak and provide information to the press on specific issues.

Emphasizing this, at the press conference of the second quarter of 2016, the Spokesperson of the Ministry of Justice, Deputy Minister Tran Tien Dung said: With detailed regulations on the positions that are proactively providing information to the press, it will create conditions for the press to access more easily and fully the activities of the Ministry of Justice.

According to many reporters, the Ministry of Justice is one of the ministries and branches that seriously implement the Government's Regulations on speaking and providing information to the press.

Article 2. Spokesperson and information provider to the press

1. Spokespersons and information providers for the press of the Ministry of Justice include:

a) Minister of Justice;

b) The Chief of Office of the Ministry of Justice is the Spokesperson and regularly provides information to the press of the Ministry of Justice (hereinafter referred to as the Spokesperson of the Ministry of Justice);

c) In case of necessity, the Minister of Justice shall authorize a responsible person of the Ministry to speak (hereinafter referred to as the Authorized Spokesperson of the Ministry of Justice) or coordinate with the Spokesperson of the Ministry of Justice to speak or provide information to the press on specific assigned issues.

2. Spokespersons and information providers for the press of the Civil Judgment Enforcement Agency in each province and centrally-run city include:

a) Director of the Civil Judgment Enforcement Department of a province or centrally-run city;

b) In case of necessity, the Director of the Civil Judgment Enforcement Agency shall authorize another responsible person of the Agency or the Head of the Civil Judgment Enforcement Sub-Department at the district level (hereinafter referred to as the Authorized Spokesperson of the Civil Judgment Enforcement Agency in each province or centrally-run city) to speak and provide information to the press on specific assigned issues.

3. The full name, position, telephone number and email address of the Spokesperson of the Ministry of Justice and the Civil Judgment Enforcement Agency in each province or centrally-run city shall be announced in writing to press agencies and state press management agencies at the same level and posted on the agency's electronic information portal.

4. Spokespersons and authorized spokespeople of the Ministry of Justice and the Civil Judgment Enforcement Agency in each province or centrally-run city as prescribed in this Article shall not be authorized to re-authorize to others. Authorization to speak shall be made in writing, shall only be applied in each case, and shall have a certain time limit.

Article 3. Rights and responsibilities of Heads of some units under the Ministry of Justice and other individuals in providing information to the press

1. The Director General of the General Department of Civil Judgment Enforcement, the Director of the Department of Inspection of Legal Normative Documents, the Director of the Department of Administrative Procedure Control, the Director of the Department of Administrative Violations Handling and Law Enforcement Monitoring, and the Rector of Hanoi Law University under the Ministry of Justice shall proactively provide information to the press on professional activities in each specialized field assigned to them or within the scope and in accordance with the nature of the assigned tasks (for Hanoi Law University). In case of providing information on complex and sensitive issues, it is necessary to report to the Minister of Justice through the Spokesperson of the Ministry.

2. Individual units under the Ministry and the Civil Judgment Enforcement Agency in each province and centrally-run city are allowed to provide information to the press according to the provisions of law but not on behalf of the Ministry of Justice or the Civil Judgment Enforcement Agency.

3. Heads of units mentioned in Clause 1 of this Article and individuals mentioned in Clause 2 of this Article must not disclose investigation secrets, state secrets, official secrets, or provide false information; must be honest when providing information to the press and be personally responsible before the law and before the Head of the agency for the content of the information provided.
