Land compensation when the State reclaims non-agricultural land
Mr. NVB in Dien Chau district asked: According to the 2024 Land Law, how is land compensation regulated when the State reclaims non-agricultural land that is not residential land of households and individuals?
Article 99 of the 2024 Land Law stipulates as follows:
1. Households and individuals using non-agricultural land other than residential land when the State recovers land, if they meet the conditions for compensation prescribed in Article 95 of this Law, shall be compensated with land with the same purpose of use as the recovered land or with money according to the remaining land use term for land with a limited use term or with land with a purpose of use different from the recovered land or with housing.
2. Households and individuals using non-agricultural land that is not residential land and are leased land by the State and pay land rent once for the entire lease term but are exempted from land rent when the State reclaims the land, if they meet the conditions for compensation prescribed in Article 95 of this Law, they will be compensated for the land.
3. The Government shall detail this Article.
