Compensation for land when the State reclaims non-agricultural land.
Mr. NVB from Dien Chau district asks: According to the 2024 Land Law, how is compensation for land when the State reclaims non-agricultural land that is not residential land of households and individuals regulated?
Article 99 of the 2024 Land Law stipulates as follows:
1. Households and individuals using non-agricultural land other than residential land, when the State reclaims the land, if they meet the conditions for compensation stipulated in Article 95 of this Law, shall be compensated with land of the same purpose as the reclaimed land, or with money for the remaining land use period for land with a limited use period, or with land of a different purpose than the reclaimed land, or with housing.
2. Households and individuals using non-agricultural land other than residential land that is leased from the State with a one-time payment of rent for the entire lease period, but are exempt from rent when the State reclaims the land, shall be compensated for the land if they meet the conditions for compensation stipulated in Article 95 of this Law.
3. The Government shall provide detailed regulations for this Article.
