What conditions must individuals meet when soliciting donations for natural disasters?
When natural disasters occur, many organizations and individuals are called upon to donate. However, what conditions must individuals meet when soliciting donations due to natural disasters? This is a question of concern for Ms. Nguyen Thi Hien (Do Luong commune, Nghe An province).
Reply:Based on Article 17 of Decree 93/2021/ND-CP, the procedures for soliciting and receiving voluntary contributions from individuals are as follows:
- When soliciting, receiving, and distributing voluntary contributions to support disaster relief, epidemics, and emergencies, individuals are responsible for informing the media about the following:
+ Purpose, scope, methods, and forms of movement.
+ Receiving account (for money);
+ Receiving location (for artifacts);
+ The commitment to distribute and send the goods in writing to the People's Committee of the commune where the recipient resides, using the notification form issued with Decree 93/2021/NĐ-CP.
The People's Committee at the commune level is responsible for storing, monitoring, and providing information upon request from organizations and individuals contributing or receiving support, and to competent authorities for guidance, monitoring, inspection, supervision, and handling of violations.
- Individuals should open separate accounts at commercial banks for each fundraising campaign to receive and manage all voluntary contributions, and arrange suitable locations for receiving, managing, and storing donated items during the collection period;
Receipts will be issued for all voluntary contributions in cash and in kind received, upon request from the contributing organization or individual.
Note: Individuals are not permitted to receive further voluntary contributions after the committed contribution period has ended and are responsible for notifying the account holder of the cessation of voluntary contribution acceptance.
