Prohibited acts under the Identity Card Law

Mr. Luong Van Hoa, residing in Quy Hop district, asks: What actions are strictly prohibited under the Identity Card Law?

TAnswer:

The Law on Identity Cards was passed by the 15th National Assembly of the Socialist Republic of Vietnam at its 6th session on November 27, 2023, and came into effect on July 1, 2024.

According to Article 7 of the 2023 Identity Card Law, there are 9 prohibited acts, including:

1. Issuing, replacing, reissuing, or revoking identity cards or identity certificates in violation of the law.

2. Retaining identity cards or identity certificates in violation of the law.

3. Harassment, causing inconvenience, and discrimination when handling administrative procedures related to identity cards, the National Population Database, and the Identity Card Database.

4. Falsifying records and documents regarding identity, information in the National Population Database and the Identity Database; failing to provide, providing incomplete, providing inaccurate, or providing information and documents regarding identity or information in the National Population Database and the Identity Database in violation of the law.

5. Failure to carry out the procedures for issuing identity cards as prescribed in Clause 2, Article 19 of this Law.

6. Producing, using tools, equipment, software, or engaging in other activities that hinder or disrupt the operation of the information infrastructure of the National Population Database and the Identity Card Database, and the electronic identification and authentication system.

7. Forging, altering, or intentionally falsifying the content of identity cards, electronic identity cards, or identity certificates; appropriating or illegally using identity cards, electronic identity cards, or identity certificates belonging to others; renting, leasing, pawning, accepting as collateral, or destroying identity cards or identity certificates; using counterfeit identity cards, counterfeit electronic identity cards, or counterfeit identity certificates.

8. Accessing, altering, deleting, destroying, distributing, or performing other activities related to the processing of personal data in the National Population Database, the Identity Card Database, and the electronic identification and authentication system in violation of the law.

9. Exploiting, sharing, buying, selling, exchanging, appropriating, or illegally using information and data in the National Population Database, the Identity Card Database, and the electronic identification and authentication system.
