Cases requiring registration of land use changes.

Mr. NQH from Nghi Loc district asks: According to the 2024 Land Law, in which cases is it necessary to register land use changes?

Article 133 of the 2024 Land Law stipulates the registration of changes, specifically as follows:

1. Registration of changes is required in cases where a Certificate of Land Use Rights or a Certificate of Ownership of Housing and Land Use Rights or a Certificate of Ownership of Housing or a Certificate of Ownership of Construction Works or a Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land or a Certificate of Land Use Rights and Ownership of Assets Attached to Land has been issued, and the following changes occur:

a) Land users and owners of assets attached to the land exercise the rights to convert, transfer, inherit, and donate land use rights and assets attached to the land; contribute capital in the form of land use rights and assets attached to the land; lease and sublease land use rights in infrastructure construction and business projects; and transfer projects involving land use.

b) Land users and owners of assets attached to the land are permitted to change their names;

c) Changes to information regarding land users and owners of assets attached to the land on the issued certificate, excluding cases specified in point b of this clause;

d) Changes to the boundaries, landmarks, dimensions of sides, area, number, and address of the land parcel;

d) Registering ownership rights to assets attached to land parcels for which a Certificate of Land Use Rights or Certificate of Ownership of Housing and Land Use Rights or Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land or Certificate of Land Use Rights, Ownership of Assets Attached to Land has been issued; registering changes to assets attached to land compared to the registered content;

e) Changing the land use purpose as stipulated in Clause 1, Article 121 of this Law; in cases stipulated in Clause 3, Article 121 of this Law where the land user wishes to register the change;

g) Changes to the land use term;

h) Changes to the forms of land allocation, land lease, payment of land use fees, and land rent as prescribed by this Law;

i) Changes in land use rights and ownership of assets attached to the land due to division, separation, merger, consolidation, conversion of organizational model, or agreement of household members, or of husband and wife, or of a group of joint land users, or a group of joint owners of assets attached to the land;

k) Changes to land use rights and ownership of assets attached to land based on the results of successful mediation of land disputes recognized by the competent People's Committee; agreements in mortgage contracts to settle debts; decisions of competent state agencies on resolving land disputes, complaints, and denunciations regarding land; judgments and decisions of the Court, enforcement decisions of the enforcement agency that have been implemented; decisions or rulings of the Vietnam Commercial Arbitration on resolving disputes between parties arising from commercial activities related to land; documents recognizing the results of land use right auctions in accordance with the law;

l) Establishing, changing, or terminating rights over adjacent land parcels;

m) Changes to restrictions on land users' rights;

n) Changes in land use rights for constructing above-ground structures to serve the operation and exploitation of underground structures, and ownership rights of underground structures;

o) Land users and owners of assets attached to the land request the exchange or re-issuance of the Certificate of Land Use Rights or Certificate of Ownership of Housing and Land Use Rights or Certificate of Ownership of Housing or Certificate of Ownership of Construction Works or Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to the Land or Certificate of Land Use Rights, Ownership of Assets Attached to the Land;

p) Land users and owners of assets attached to the land exercise the right to mortgage the right to use the land and the assets attached to the land;

q) Selling, transferring, or assigning land use rights that are public assets in accordance with the law on the management and use of public assets.
