Answer: According to the provisions of Clause 4, Article 3 of the 2024 Land Law, land improvement and restoration are understood as the application of management, technical, mechanical, biological, and organic measures to the land to treat polluted land and restore degraded land.
Land improvement and restoration under the new law is implemented according to Article 54 of the 2024 Land Law, which stipulates Land protection, improvement and restoration as follows:
1. Contents of land protection, improvement and restoration include:
a) Classify the zoned land areas according to the provisions in Point c, Clause 1, Point c, Clause 2 and Point c, Clause 3, Article 53 of this Law;
b) Synthesize and determine the scope and level of land protection, improvement and restoration required for each land area classified in Point a of this Clause;
c) Develop a plan and roadmap for implementing land protection, improvement and restoration for the land areas identified in Point b of this Clause;
d) Determine technical measures, economic and social solutions with analysis to select the optimal solution and decide on the implementation plan;
d) Prepare a report on the results of land protection, improvement and restoration;
e) Monitor and control the process of land treatment, protection, improvement and restoration.
2. Mapping land areas where land protection, improvement and restoration have been implemented; building and updating data on land protection, improvement and restoration into the national land database.
3. Control degraded and polluted land areas that have not been protected, renovated or restored as prescribed in Clause 1 of this Article, including zoning, warning, not allowing or restricting activities on the land to minimize negative impacts on the land.
Thus, according to the above provisions, land improvement and restoration activities under the new law are carried out according to the following contents:
(1) Classification of zoned land areas;
(2) Synthesize and determine the scope and level of land protection, improvement and restoration required for each classified land area;
(3) Develop a plan and roadmap for implementing land protection, improvement and restoration for identified land areas;
(4) Determine technical measures, economic and social solutions with analysis to select the optimal solution and decide on the implementation plan;
(5) Prepare reports on the results of land protection, improvement and restoration;
(6) Monitor and control the process of land treatment, protection, improvement and restoration.
