What are the specific provisions regarding land reclamation and restoration under the new law? This is a question of concern to Mr. Hoang Van Hieu (Nghi Loc, Nghe An).

Answer: According to Clause 4, Article 3 of the 2024 Land Law, land remediation and land restoration are understood as the application of management, technical, mechanical, biological, and organic measures to treat polluted land and restore degraded land.

Land reclamation and restoration under the new law are implemented according to Article 54 of the 2024 Land Law, which stipulates the protection, reclamation, and restoration of land as follows:

1. The content of land protection, improvement, and restoration includes:

a) Classify the land areas that have been demarcated according to the provisions of point c, clause 1, point c, clause 2 and point c, clause 3, Article 53 of this Law;

b) Synthesize and determine the scope and extent of land protection, rehabilitation, and restoration needed for each land area classified in point a of this section;

c) Develop a plan and roadmap for the protection, remediation, and restoration of land in the areas identified in point b of this section;

d) Identify technical measures, economic and social solutions, along with analyses, to select the optimal option and decide on its implementation;

d) Prepare a report on the results of land protection, remediation, and restoration;

e) Monitoring and controlling the process of land treatment, protection, remediation, and restoration.

2. Mapping areas where land protection, improvement, and restoration have been implemented; building and updating data on land protection, improvement, and restoration into the national land database.

3. Control degraded and polluted land areas that have not been protected, rehabilitated, or restored according to the provisions of Clause 1 of this Article, including demarcation, warning, prohibiting or restricting activities on the land to minimize adverse impacts on the land.

Thus, according to the above regulations, land reclamation and restoration activities under the new law are carried out according to the following contents:

(1) Classification of demarcated land areas;

(2) Synthesize and determine the scope and level of land protection, improvement, and restoration needed for each classified land area;

(3) Develop plans and implementation roadmaps for land protection, improvement and restoration for identified land areas;

(4) Identify technical measures, economic and social solutions along with analyses to select the optimal option and decide on the implementation plan;

(5) Prepare a report on the results of land protection, improvement and restoration;

(6) Monitoring and controlling the process of land treatment, protection, improvement and restoration.
