Mortgaging red book to borrow money then… declaring bankruptcy
(Baonghean.vn) - Kieu Hai Van used the red book to borrow money from the victim, then asked to borrow it back, mortgaged it at the bank, and transferred it to someone else. When accused, Van declared bankruptcy.
The Quy Hop Police Investigation Agency said that the unit has issued a decision to prosecute the case, prosecute the accused Kieu Hai Van (born in 1982, residing in block 6, Quy Hop town) to investigate the crime of "Fraudulent appropriation of property".
Defendant Kieu Hai Van was released on bail, and was banned from leaving her place of residence because she is raising a child under 36 months old. Van is the wife of Nguyen Anh Tu (born in 1984, a transaction officer at a bank in Quy Hop).

According to the accusation of Ms. Nguyen Thi Van (born in 1966, residing in block 17, Quy Hop town): On December 7, 2016, Kieu Hai Van brought land use right certificate No. X249432 to mortgage to Ms. Nguyen Thi Van, borrowing 300 million VND to use for the purpose of paying off debts to people Kieu Hai Van had borrowed from before.
About 10 days later, Kieu Hai Van borrowed the land use rights certificate to mortgage to the bank to borrow money, then pay off the loan between Kieu Hai Van and Ms. Van. Ms. Van agreed.
On January 4, 2017, the couple Kieu Hai Van and Nguyen Anh Tu completed the procedures to transfer the land use right certificate from the owners, Mr. Truong Quoc Bieu and Ms. Ta Thi Tien, to the names of Nguyen Anh Tu and Kieu Hai Van and then brought it to the bank to mortgage but failed.
Because he needed money to pay off debts to previous borrowers, on January 6, 2017, Kieu Hai Van continued to bring the land use right certificate above to mortgage to Ms. Nguyen Thi Lan (Block 4, Quy Hop town) to borrow 300 million VND without saying that this certificate was mortgaged to Ms. Van.
On January 9, 2017, Hai Van went to see Ms. Lan to borrow the land use right certificate to complete the bank loan procedures and promised to pay Ms. Lan after getting the bank loan. On January 10, 2017, Hai Van mortgaged the land use right certificate at the bank where her husband worked, borrowing 1.4 billion VND, but then did not pay Ms. Van and Ms. Lan but used this money to pay off the debt to Mr. Hoang Van Cong (residing in block 17, Quy Hop town).
Ms. Van and Ms. Lan repeatedly asked for payment, but Kieu Hai Van declared bankruptcy and was unable to pay. On January 20, 2017, Kieu Hai Van sold the above land plot to Ms. Cao Thi Thu (in Yen Hop commune) without informing Ms. Van and Ms. Lan.
After buying the land, Ms. Thu paid off Hai Van's loan at the bank to get the land use rights certificate and then completed the procedures to change the ownership of this land plot. To date, Ms. Nguyen Thi Lan and Ms. Nguyen Thi Van have not yet recovered the money they lent Kieu Hai Van.
Up to now, the couple Kieu Hai Van and Nguyen Anh Tu have shown signs of losing their ability to pay their debts and are trying to avoid responsibility. Facing the risk of losing more than 3 billion VND, Ms. Lan and Ms. Van, along with many other victims, have filed a complaint with the Quy Hop District Police Department denouncing the Hai Van couple's fraudulent appropriation of property.
According to many victims, under the guise of bank officials, Kieu Hai Van and Nguyen Anh Tu borrowed money from many people to pay off bank debts. The victims of Tu and his wife were mainly acquaintances such as friends, relatives, in-laws and business people who often transacted with the bank through Tu.
Considering the seriousness of the case as the subject defrauded many individuals, the authorities have actively investigated and expanded the case. During the investigation, the police initially determined that Kieu Hai Van had committed fraud to appropriate 300 million VND from Ms. Nguyen Thi Lan. Regarding the other victims, the police are continuing to investigate and clarify.
Through investigation, the leader of Quy Hop District Police also confirmed that the debt was a private matter of Van Tu and his wife, unrelated to banking operations. The police agency checked all of Tu's previous transactions, but found no signs of monetary security violations.
The Investigation Police Agency of Quy Hop District Police has transferred the case file to the People's Procuracy of Quy Hop District.
