The new policy will take effect from August 2026.

New regulations on administrative penalties for violations in livestock farming.

On June 16, 2026, the Government issued Decree 211/2026/ND-CP stipulating administrative penalties for violations in the livestock sector. The Decree takes effect from August 5, 2026.

The new decree establishes strict financial sanctions to tighten market discipline, with maximum fines of up to 100 million VND for individuals and 200 million VND for organizations.

Notably, violations related to the business, production, import and export of livestock breeds, animal feed, and waste treatment products will be subject to a statute of limitations of up to two years.

In addition, violating businesses may also face supplementary sanctions such as license revocation, suspension of business operations, mandatory recall, recycling or destruction of substandard products, and confiscation of all illegal profits obtained from the violation.

Incentives and bidding costs for selecting investors

The Government has issued Decree No. 274/2026/ND-CP detailing certain provisions and implementation measures of the Law on Bidding regarding the selection of investors to carry out business investment projects. The Decree takes effect from August 21, 2026.

The decree clearly stipulates financial incentives for investors applying high technology, green technology (5% incentive), or committing to technology transfer (2% incentive) when evaluating bid documents.

In addition, the Decree standardizes the cost limits for investor selection: the cost of preparing bidding documents is capped at 200 million VND (0.05% of total investment capital), the cost of evaluating bids is capped at 200 million VND (0.03%), and the cost of resolving complaints is capped at 200 million VND. The price of electronic copies of international bidding documents is capped at 30 million VND.

New regulations on duty-free business.

The government issued Decree No. 273/2026/ND-CP on July 7, 2026, regarding the business of duty-free goods. One of the notable new points of Decree 273/2026/ND-CP is the regulation facilitating the purchase of duty-free goods by utilizing electronic data from national and specialized databases.

According to Clause 6, Article 5 of Decree 273/2026/ND-CP, when purchasing duty-free goods, if the buyer's information has been connected and shared from the National Population Database or specialized databases, the buyer is not required to present paper copies of documents containing that information.

This regulation applies to cases eligible for duty-free purchases under Decree 273/2026/ND-CP, including: departing and transit passengers; arriving passengers; passengers on international flights; individuals entitled to privileges and immunities; and crew members working on international seagoing vessels.

According to the old regulations in Article 3 of Decree 100/2020/ND-CP, when purchasing duty-free goods, each group of eligible individuals had to present documents to prove they met the purchasing conditions.

This Decree shall take effect from August 21, 2026.

"Tighten" management and accurately calculate the amount of illegal profits from land violations.

The Government issued Decree 281/2026/ND-CP amending and supplementing a number of articles of Decree No. 123/2024/ND-CP dated October 4, 2024 of the Government regulating administrative sanctions in the field of land.

The decree clearly stipulates that all illegal profits obtained from the misuse of land must be fully remitted to the State budget. In cases where multiple parties violate the regulations on the same plot of land, the financial obligations will be divided equally; it also allows for deductions from any amounts previously paid to the State budget by the violators.

In addition, the Decree increases the maximum fine for the Chairman of the People's Committee at the commune level to 250 million VND and for the department/inspection team to 400 million VND. The regulation imposing a fine of 2-3 million VND for delayed registration of land use changes continues to be maintained, except in cases where the agreement is to acquire land use rights for investment projects.

The decree takes effect from August 31, 2026.

From August 15th, cars carrying children without appropriate safety equipment will be fined a warning.

The Government issued Decree No. 238/2026/ND-CP dated June 26, 2026, amending and supplementing a number of articles of Decree No. 168/2024/ND-CP dated December 26, 2024, of the Government regulating administrative sanctions for violations of traffic order and safety in the field of road transport; and the deduction and restoration of points on driver's licenses.

One of the notable provisions of Decree No. 238/2026/ND-CP is the addition of Clause 1a before Clause 1 of Article 6 of Decree No. 168/2024/ND-CP regarding penalties for transporting children in vehicles without using safety equipment. Accordingly, a warning penalty will be imposed on drivers of automobiles who transport children under 10 years old and under 1.35 meters tall without using appropriate child safety equipment as prescribed (except for passenger transport vehicles).

This Decree shall take effect from August 15, 2026.

From January 1, 2028, contract vehicles must share transportation contract data with the Ministry of Public Security.

The Government issued Decree No. 218/2026/ND-CP dated June 19, 2026, amending and supplementing a number of articles of Decree No. 158/2024/ND-CP dated December 18, 2024, regulating road transport activities.

Specifically, Decree No. 218/2026/ND-CP supplements Clauses 11 and 12 of Article 7 of Decree No. 158/2024/ND-CP, stipulating regulations related to the connection and sharing of data on the contents of passenger transport contracts. Accordingly, from January 1, 2028, passenger transport businesses operating under contract must connect and share data on the contents of passenger transport contracts with the Ministry of Public Security (Traffic Police Department) before each trip. Data from the Ministry of Public Security's system (Traffic Police Department) will be used to serve patrol, control, and other related operations; and data will be connected and shared with the Ministry of Construction (Vietnam Road Administration), the Ministry of Finance (Tax Department, Customs Department), and provincial People's Committees (Department of Construction) to serve state management according to their functions and duties.

This Decree shall take effect from August 10, 2026.

From August 1st, it is prohibited to bring laptops, phones, and smartwatches into courtrooms without permission.

This is a noteworthy point in Circular No. 12/2026/TT-TANDTC regarding the rules of court sessions and meetings, and the recording of speeches and images of court proceedings.

Article 4 of Circular 12/2026/TT-TANDTC states that it is prohibited to bring devices for transmitting, collecting, processing, storing, or exchanging digital information and data, such as phones, tablets, laptops, smartwatches, etc., with video recording capabilities, except when permitted by the presiding judge of the trial or the person chairing the hearing.

The use of electronic devices to access records, documents, evidence, conduct online trials, or record speech and video of court proceedings and hearings with participants in the proceedings must be under the direction of the judge.

Audio recording is permitted during court proceedings and hearings. Video recording of court proceedings and hearings is only permitted during the opening of the proceedings and the pronouncement of judgments and decisions.

Recording spoken words during court proceedings or hearings, and recording images of the judicial panel and judges during the opening of the trial or hearing and the pronouncement of judgments or decisions, requires the consent of the presiding judge or the judge chairing the hearing.

The official circular came into effect on August 1st.

Expanding the legal framework for financial leasing and digitizing credit transactions.

The State Bank of Vietnam issued Circular 31/2026/TT-NHNN detailing the financial leasing activities of general finance companies and financial leasing companies. The Circular takes effect from August 15, 2026.

The new legal framework represents a breakthrough by officially including "property rights" such as software, data, exploitation rights, and intellectual property in the list of assets eligible for financial leasing. Simultaneously, the document defines the mechanism for electronic financial leasing, regulates small-value lease packages under 400 million VND with a simplified appraisal process, making it easier for businesses to access medium and long-term capital for technological and machinery upgrades.

This policy promises to boost the development of the financial leasing market, supporting the optimization of working capital and fixed assets for businesses in the digital economy.
