If the landlord dies, can the tenant continue to live in the property?
I signed a 3-year lease agreement, but the landlord recently passed away. Is the contract still valid? Can I continue renting? This is a question from Mr. Le Ha A. (Nghi Loc commune, Nghe An province).
ReplyAccording to Clause 1, Article 173 of the 2023 Housing Law, if the homeowner dies while the lease agreement is still valid, the tenant is entitled to continue renting until the end of the signed term.
This regulation also states that the landlord's heirs are responsible for continuing the lease agreement, unless the parties agree otherwise.
Therefore, the landlord's death does not terminate the lease agreement; the tenant's rights are still protected according to the signed contract.
In cases where the owner has no legal heirs, according to Article 622 of the 2015 Civil Code, the property will belong to the State after fulfilling all related obligations. In that case, renting the house will be governed by regulations on the management and use of state-owned housing.
