Chairman of the People's Committee of Nghe An province, Nguyen Duc Trung, presided over the regular citizen reception session in December 2023.
(Baonghean.vn) - On the morning of December 15th, Mr. Nguyen Duc Trung, Deputy Secretary of the Provincial Party Committee and Chairman of the Provincial People's Committee, presided over the regular citizen reception session for December 2023.
Attending the public consultation session were Comrade Thai Thi An Chung - Member of the Provincial Party Committee, Deputy Head of the Provincial National Assembly Delegation; representatives from the Office and Party committees of the Provincial Party Committee, the Provincial Fatherland Front Committee; and leaders of departments, agencies, and Tan Ky district.

The Chairman of the People's Committee of Nghe An province, Nguyen Duc Trung, received citizen Nguyen Thi Sam, residing in Block 5, Tan Ky town (Tan Ky district). Ms. Sam complained that the People's Committee of Tan Ky district did not issue land use right certificates for plots No. 154 and 187, on map No. 15, Nghia Hoan commune, Tan Ky district, to her family as required by law, affecting her family's legitimate rights and interests.

Ms. Sam stated that her family purchased these two plots of land from three households in 1998 and 2000. Her family fulfilled their financial obligations, and the purchase was certified by Nghia Hoan commune. The land was used by her family for the production of construction materials from 1998 to 2017, after the government implemented a policy to eliminate manual tile kilns.
Reporting on the details of the case, Chairman of Nghia Hoan Commune People's Committee Nguyen Dinh Hung stated that after receiving Ms. Sam's documents, the commune checked and verified the origin and history of land use. This is 5% land managed by the Commune People's Committee, leased to households for the construction of manual tile kilns, with annual payments of land lease fees to the Commune People's Committee.

Pham Hong Son, Vice Chairman of the Tan Ky District People's Committee, also stated that Ms. Sam's application for a land use right certificate did not meet the requirements. This land, which is 5% of the land managed by Nghia Hoan commune, is not in accordance with the land use plan as it is currently used for production and business purposes and is planned for the construction of an industrial cluster by the district.

According to Pham Van Toan, Deputy Director of the Nghe An Department of Natural Resources and Environment, the authority to issue the first land use right certificate rests with the Chairman of the District People's Committee. Therefore, the Chairman of the Tan Ky District People's Committee must provide a final written response stating whether Ms. Sam's application meets the conditions for issuing a land use right certificate.

After listening to the opinions of the relevant parties and concluding the meeting with the public, Chairman of the Provincial People's Committee Nguyen Duc Trung stated that Ms. Sam's use of the two plots of land for the production of construction materials has been ongoing for a long time. In accordance with the State's policy on eliminating manual brick kilns, Ms. Sam's family has complied.
Regarding the origin of the land use, Ms. Sam stated that she purchased it from three households. However, according to a report from Nghia Hoan commune, this area is classified as 5% land, managed by the commune, and does not meet the conditions for granting land use rights certificates to citizens. Regarding planning, this area has been planned for production and business purposes, but the land is currently vacant, and no households have been granted land use rights certificates.
Over the past period, Tan Ky district, Nghia Hoan commune, and the Tan Ky District Land Registration Office branch have considered and resolved Ms. Sam's petition, but the citizen has not yet agreed to the resolution.

Emphasizing that this is a case of issuing a land use right certificate for the first time, Chairman of the Provincial People's Committee Nguyen Duc Trung stated that the authority to issue land use right certificates rests with the Chairman of the District People's Committee.
Therefore, to ensure the legitimate rights and interests of citizens, the Chairman of the Provincial People's Committee, Nguyen Duc Trung, instructed the Chairman of the Tan Ky District People's Committee to establish a working group to review and verify the origin, usage history, and sales history of the land plots. Based on this, they are to determine whether the two land plots meet the conditions for granting land use rights certificates to citizens, and then provide a written response to the citizens before January 30, 2024, and report to the Provincial People's Council.
During the implementation process, the Department of Natural Resources and Environment will guide Tan Ky district in reviewing and resolving the matter in accordance with the law. If, after resolution, the citizen still disagrees, the citizen has the right to exercise their right to appeal in accordance with the regulations.
Regarding Mrs. Sam's household and other households that previously owned land for building materials production, the Chairman of the Provincial People's Committee requested that Tan Ky district, in the coming period, address the issue of reorganizing production activities and attracting businesses to invest, while also ensuring the legitimate rights of the people.
