Chairman of Nghe An Provincial People's Committee receives citizens at regular session in October

At the citizen reception, Mr. Vo Tien Luy, Trung Hoa block, Le Mao ward, Vinh city proposed to consider and grant a Land Use Right Certificate to his family for the land area north of Ghe residential area, hamlet 5, Khai Son commune, Anh Son district.

The case of Mr. Luy has been investigated by the authorities. Accordingly, in February 2021, the Provincial People's Committee issued a document assigning the People's Committee of Anh Son district to guide Mr. Vo Tien Luy to declare and complete all documents and procedures to apply for a Land Use Right Certificate in accordance with current law, and send them to the People's Committee of Khai Son commune and the People's Committee of Anh Son district for consideration and settlement. Subsequently, the People's Committee of Anh Son district and the People's Committee of Khai Son commune took action to consider and settle the case.

On July 26, 2021, Khai Son Commune People's Committee issued a Notice to Mr. Vo Tien Luy regarding the results of reviewing his application for a Land Use Rights Certificate.

It clearly states: Based on the documents he provided, based on the results of the land cadastral survey, the origin, land use process, current land use status, as well as the provisions of the law related to the implementation of the Land Law, the Land Registration Council of Khai Son commune concluded that Mr. Vo Tien Luy's application for the land in the Ghe area, village 5, Khai Son commune did not meet the conditions for granting a Land Use Rights Certificate. However, Mr. Luy did not agree with this content.

At the meeting, Chairman of the Provincial People's Committee Nguyen Duc Trung listened to citizens' opinions and views on the incident as well as the basis and process of handling the incident by the People's Committee of Anh Son district, the People's Committee of Khai Son commune, the Provincial Inspectorate, and the Department of Natural Resources and Environment.

Concluding this content, the Chairman of the Provincial People's Committee emphasized that the general viewpoint of the Provincial Citizen Reception Council when handling cases related to citizens' complaints is based on the principle of ensuring the legal and legitimate rights of citizens.

Chairman of the Provincial People's Committee Nguyen Duc Trung also requested the Department of Natural Resources and Environment to coordinate with the Provincial Inspectorate and the Department of Justice to re-verify the contents to respond to citizens before November 15, 2021.

Accordingly, first of all, review the entire dossier of granting Land Use Right Certificates for 6 plots of land adjacent to the plot of land that Mr. Vo Tien Luy is requesting to be granted Land Use Right Certificates to ensure that the procedures and regulations are correct, and the location of the land grant is in accordance with the planning.

Previously, at the meeting, Mr. Luy said that the location of these 6 land lots was not in accordance with the planning, while the leader of Anh Son District People's Committee affirmed that compared to the planning drawing, the location from the auction to the land allocation was appropriate and the issuance of the Land Use Right Certificate to the 6 households that won the auction was for the right subjects. All 6 households that won the auction have been using the land stably up to now.

As for the area that Mr. Vo Tien Luy requested to be granted a Certificate of Land Use Rights in Ghe area, village 5, Khai Son commune, the Land Registration Council of Khai Son commune concluded that his application did not meet the conditions for granting a Certificate of Land Use Rights.

Regarding this content, the Chairman of the Provincial People's Committee requested that, after re-verifying, if the procedures and documents are in accordance with regulations, land will be granted to citizens; if the regulations for granting a Land Use Right Certificate are not met, a clear response will be given to citizens that the conditions are not met.

Comrade Nguyen Duc Trung requested citizens to cooperate with the government to comply with the contents that will be concluded by the authorities and notified to citizens after they have been verified again. In case citizens still disagree with the settlement results, they have the right to complain to the State administrative agency or file a lawsuit in court for consideration and handling according to the provisions of law.

Next, the Chairman of the Provincial People's Committee received Ms. Bach Thi Huong, Kim My hamlet, Nghi An commune, Vinh city, who proposed to consider allocating a resettlement land plot of 35m road (connecting National Highway 46 to Hung Hoa commune, Vinh city), which is part of the planning to divide resettlement land plots in Kim My hamlet, Nghi An commune according to the commitment between Vinh city People's Committee and her family.

Regarding this content, in response to the citizen, the Chairman of the Provincial People's Committee said: The content of the petition of the family has been reported by the Vinh City People's Committee to the Provincial People's Committee, and at the same time expressed sympathy with the citizen's feelings.

However, at present, the content of this petition is not only of her household but also related to many other households within the scope of the project, so the Provincial People's Committee is assigning the Department of Natural Resources and Environment to review and advise on a solution based on the request of Vinh City.

After that, based on the advice of the Department of Natural Resources and Environment, the People's Committee leaders will chair a meeting to comprehensively consider issues related to resolving citizens' petitions in general, including Ms. Bach Thi Huong's family. The results will be announced to the people before November 30, 2021.
