The Chairman of the People's Committee of Nghe An province held a regular monthly meeting with citizens in October.

During the public consultation session, Mr. Vo Tien Luy, residing in Trung Hoa block, Le Mao ward, Vinh City, requested that his family be considered for and granted a land use right certificate for the land area north of the Ghe residential area, Hamlet 5, Khai Son commune, Anh Son district.

The case of Mr. Luy has been investigated by the relevant authorities. Accordingly, in February 2021, the Provincial People's Committee issued a document instructing the Anh Son District People's Committee to guide Mr. Vo Tien Luy in declaring and completing all necessary documents and procedures to apply for a Land Use Right Certificate in accordance with current laws, and to submit them to the Khai Son Commune People's Committee and the Anh Son District People's Committee for consideration and resolution. Subsequently, the Anh Son District People's Committee and the Khai Son Commune People's Committee began to review and resolve the matter.

On July 26, 2021, the People's Committee of Khai Son commune issued a notice to Mr. Vo Tien Luy regarding the results of the review of his application for a land use right certificate.

The document clearly states: Based on the documents he provided, the results of the land survey, the origin and history of land use, the current land use status, and relevant legal regulations on the implementation of the Land Law, the Land Registration Council of Khai Son commune concludes that Mr. Vo Tien Luy's application for the land in the Ghe area, Hamlet 5, Khai Son commune, does not meet the conditions for granting a Certificate of Land Use Rights. However, Mr. Luy disagrees with this conclusion.

During the meeting, Chairman of the Provincial People's Committee Nguyen Duc Trung listened to the opinions and views of citizens regarding the case, as well as the basis and process of resolving the case by the Anh Son District People's Committee, the Khai Son Commune People's Committee, the Provincial Inspectorate, and the Department of Natural Resources and Environment.

Concluding this discussion, the Chairman of the Provincial People's Committee emphasized that the general stance of the Provincial Citizen Reception Council when handling cases related to citizens' complaints is based on the principle of ensuring the legitimate and rightful interests of citizens.

Chairman of the Provincial People's Committee Nguyen Duc Trung also requested the Department of Natural Resources and Environment to coordinate with the Provincial Inspectorate and the Department of Justice to re-verify the contents and provide a response to citizens before November 15, 2021.

Accordingly, the first step is to review all the land use right certificate application files for the six adjacent plots of land that Mr. Vo Tien Luy is requesting to be granted land use right certificates, to ensure that the procedures and regulations are followed correctly, and that the land allocation location conforms to the planning.

Previously, during the meeting, Mr. Luy argued that the location of these six land plots was not in accordance with the planning regulations, while the leaders of the Anh Son District People's Committee affirmed that the location matched the planning drawings from the time of the auction to the land allocation, and that the issuance of land use right certificates to the six winning bidders was correct. All six winning bidders have been using the land stably to this day.

Regarding the land area for which Mr. Vo Tien Luy requested a land use right certificate in the Ghe area, Hamlet 5, Khai Son Commune, the Khai Son Commune Land Registration Council concluded that his application did not meet the requirements for issuing a land use right certificate.

Regarding this matter, the Chairman of the Provincial People's Committee requested that, after further verification, if the procedures and documents comply with regulations, land will be granted to citizens; if the regulations for granting a Certificate of Land Use Rights are not met, a clear statement should be given to the citizens stating that they do not meet the requirements.

Comrade Nguyen Duc Trung requested citizens to cooperate with the authorities and comply with the conclusions and announcements made by relevant agencies after further verification. If citizens still disagree with the outcome, they have the right to file a complaint with the state administrative agency or initiate legal proceedings in court for consideration and resolution in accordance with the law.

Next, the Chairman of the Provincial People's Committee received Ms. Bach Thi Huong from Kim My hamlet, Nghi An commune, Vinh City, who requested consideration for the allocation of a resettlement land plot along the 35m road (connecting National Highway 46 to Hung Hoa commune, Vinh City), which is part of the resettlement land plot plan for Kim My hamlet, Nghi An commune, as per the commitment between the Vinh City People's Committee and her family.

Regarding this matter, in response to the citizen's inquiry, the Chairman of the Provincial People's Committee stated: The content of the family's petition has been reported by the Vinh City People's Committee to the Provincial People's Committee, and he also expressed his understanding of the citizen's concerns.

However, this petition now concerns not only Mrs. [Name]'s family but also many other households within the project area. Therefore, the Provincial People's Committee is assigning the Department of Natural Resources and Environment to review and advise on a solution based on the proposal from Vinh City.

Subsequently, based on the advice of the Department of Natural Resources and Environment, the leaders of the People's Committee will chair a meeting to comprehensively consider all issues related to resolving citizens' petitions in general, including those of Ms. Bach Thi Huong's family. The results will be announced to the people before November 30, 2021.
