Chairman of Nghe An Provincial People's Committee received citizens at the regular session in February 2025
On the morning of February 17, comrade Le Hong Vinh - Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People's Committee received citizens at the regular session in February 2025.
Also attending were representatives of a number of Provincial Party Committees, the Standing Committee of the Provincial People's Council, and leaders of relevant departments, branches, and localities.

Proposal for new issuance or exchange of Land Use Rights Certificate
The Chairman of the Provincial People's Committee received Ms. Tran Thi Lien, representing 40 households living in the 20C Enterprise Collective Housing Area, Trung Tien Block, Hung Dung Ward, Vinh City, requesting the competent authority to issue the first Land Use Right Certificate to her and 40 households living in the collective housing area.
The 20C Garment Factory Collective Housing Area, Trung Tien Block, Hung Dung Ward is a family housing area and the collective housing blocks of officers and workers of 20C Garment Joint Stock Company are defense land, managed and used by X20 Joint Stock Company, General Department of Logistics, Ministry of National Defense.

This land was recovered by the People's Committee of Nghe An province in Decision No. 713/QD-UBND dated September 1, 2016 and assigned to the People's Committee of Vinh city to manage and put into use according to the planning and land use plan as prescribed by law.
According to the land use planning until 2030, the land has been adjusted from national defense land to residential land; Vinh City People's Committee approved the detailed planning of dividing residential land plots in Trung Tien block, Hung Dung ward on April 3, 2017 and adjusted the planning on June 12, 2017 with 69 land plots.

Currently, in the 69 plots of land in the above-mentioned planning area, Vinh City People's Committee has granted Land Use Right Certificates to 24 households and individuals using land with documents on being lent land by 20C Garment Enterprise according to Document No. 169/UBND-TD dated January 7, 2022 of Nghe An Provincial People's Committee on directing the settlement of petitions of households in 20C collective housing area - Ministry of National Defense.
According to the report of Hung Dung Ward People's Committee, there are currently 53 households and individuals living in the apartment buildings, including Ms. Tran Thi Lien and 40 households that she represents.
Through review and consideration, in reality, the households do not have any documents on land use because the company has not liquidated or priced the assets, but has used them in the form of leasing and monthly fee collection by the company... Therefore, Vinh City People's Committee has no basis to consider granting Land Use Rights Certificates to the households according to current regulations.

At the working session, Chairman of the Provincial People's Committee Le Hong Vinh received citizen Pham Thi Hanh, representing her mother, Ms. Nguyen Thi Hoi, Xuan Binh block, Nghi Duc ward, Vinh city.
Accordingly, on December 23, 2024, Ms. Nguyen Thi Hoi submitted a petition to the People's Committee of Vinh City with the following content: Her family has land plot No. 170 sheet 1 (now plot 114 sheet 3) in Xuan Binh hamlet, Nghi Duc commune, the land plot was used before December 18, 1980, the Nghi Duc Commune People's Committee has received the application for reissuance, re-recognition of the residential land area before 1980 and completed the processing since March 2024, but due to personal reasons, she has not yet submitted it to the People's Committee of Vinh City for processing before August 1, 2024. Now she requests to process the application according to the transitional provisions of the 2024 Land Law.
Make full use of legal provisions to ensure citizens' rights.

At the citizen reception session, leaders of Vinh City People's Committee and related departments and branches such as: Department of Natural Resources and Environment, Department of Construction, Provincial People's Committee, Provincial Bar Association, on the basis of legal regulations, discussed related contents and proposed solutions according to citizens' recommendations.

Regarding the case of Ms. Tran Thi Lien, Hung Dung Ward, Vinh City, Director of the Department of Natural Resources and Environment Hoang Quoc Viet said that, based on the provisions of the law, in order to be able to handle the citizen's petition, it is necessary to implement the direction of granting Land Use Right Certificates to people in cases of land granting beyond authority and according to Conclusion Notice No. 263 dated April 18, 2023 of Vice Chairman of the Provincial People's Committee Nguyen Van De on resolving difficulties in cases such as at the 20C Garment Enterprise collective housing area.

Regarding the case of Ms. Nguyen Thi Hoi, Xuan Binh block, Nghi Duc ward, Vinh city, based on the provisions of the law, the leaders of the departments and branches have explained that up to now, there is still no basis for implementation, including applying to handle the records according to the transitional provisions of the 2024 Land Law.
To resolve the citizen's request, the Director of the Department of Natural Resources and Environment of Nghe An requested the People's Committee of Vinh city and citizens to review the origin of land use to confirm whether or not one of the prescribed documents exists such as: Temporary land use right certificate issued by a competent State agency or listed in the Land Registration Book, Cadastral Book; Inventory book, land registration book established before December 18, 1980 with the name of the land user;...

If there is one of the documents that will be recognized as land use limit, this case can be applied. If there is no such document, it cannot be applied to either the 2013 Land Law or the 2024 Land Law to issue a new Land Use Rights Certificate.
Concluding the citizen reception session, Chairman of Nghe An Provincial People's Committee Le Hong Vinh affirmed the viewpoint of making maximum use of legal provisions to protect citizens' rights and requested relevant levels and sectors to thoroughly implement them.

Specifically, in the case of Ms. Tran Thi Lien, Hung Dung ward, Vinh city, the Chairman of the Provincial People's Committee shared the difficulties in life in the old apartment complex, as well as the wishes and needs to be allocated land without auction.
The handling is favorable because the Ministry of National Defense has handed over the land to the province and the province has planned it as residential land in this area. On that basis, the Chairman of the Provincial People's Committee agrees with the viewpoint in the Conclusion Notice No. 263 dated April 18, 2023 of the Vice Chairman of the Provincial People's Committee Nguyen Van De and the solution of the Director of the Department of Natural Resources and Environment.
On that basis, the head of Nghe An Provincial People's Committee assigned the city to continue reviewing all related subjects and procedures to ensure compliance with current regulations by the end of March 2025, to finalize a specific plan and roadmap, and report to the Provincial People's Committee to remove difficulties and obstacles for households. The Chairman of the Provincial People's Committee also requested the 20C Garment Factory to review the safety of the collective housing area to ensure the safety of the people living here.
Regarding the case of Ms. Nguyen Thi Hoi, Xuan Binh block, Nghi Duc ward, Chairman of Nghe An Provincial People's Committee Le Hong Vinh explained in detail the reason why there is no basis to resolve according to the transitional provisions of the 2024 Land Law. The key to the problem is that the family must provide documents according to the provisions of the law as pointed out by the leader of the Department of Natural Resources and Environment.
On that basis, the Chairman of the Provincial People's Committee requested citizen Pham Thi Hanh to explain to her mother, Ms. Nguyen Thi Hoi, and her family; at the same time, assigned relevant levels and sectors to coordinate and provide maximum support to her family in finding and providing relevant documents for processing.
