The Chairman of the People's Committee of Nghe An province held a regular citizen reception session in February 2025.
On the morning of February 17th, Comrade Le Hong Vinh - Deputy Secretary of the Provincial Party Committee and Chairman of the Provincial People's Committee - held the regular monthly citizen reception session for February 2025.
Also attending were representatives from several Party committees of the Provincial Party Committee, the Standing Committee of the Provincial People's Council, and leaders of relevant departments, agencies, and localities.

Request for issuance of new or replacement land use right certificate.
The Chairman of the Provincial People's Committee received Ms. Tran Thi Lien, representing 40 households residing in the 20C Enterprise residential area, Trung Tien block, Hung Dung ward, Vinh city, who petitioned the competent authorities to issue the first-time land use right certificate to her and the 40 households living in the residential area.
The residential area of the 20C Garment Factory, Trung Tien block, Hung Dung ward, consists of family housing and apartment blocks for the staff and workers of the 20C Garment Joint Stock Company. This land is national defense land, managed and used by the X20 Joint Stock Company, General Department of Logistics, Ministry of National Defense.

This land was reclaimed by the People's Committee of Nghe An province in Decision No. 713/QD-UBND dated September 1, 2016, and assigned to the People's Committee of Vinh city for management and use in accordance with the land use plan and regulations of the law.
According to the land use plan until 2030, the land area has been reclassified from national defense land to residential land; the Vinh City People's Committee approved the detailed plan for subdividing residential land plots in Trung Tien block, Hung Dung ward on April 3, 2017, and adjusted the plan on June 12, 2017, with 69 land plots.

Currently, out of the 69 land plots in the aforementioned planning area, the Vinh City People's Committee has issued land use right certificates to 24 households and individuals who have documents proving that they were allowed to borrow land from the 20C Garment Factory, in accordance with Document No. 169/UBND-TD dated January 7, 2022, of the Nghe An Provincial People's Committee regarding the direction to resolve the requests of households in the 20C residential area - Ministry of National Defense.
According to a report from the People's Committee of Hung Dung Ward, there are currently 53 households and individuals living in the collective housing blocks, including Ms. Tran Thi Lien and 40 households that she represents.
Upon review, it was found that the households did not possess any documents regarding land use because the land was not liquidated or valued by the company, but rather used through a lease arrangement with monthly fees collected from the company. Therefore, the Vinh City People's Committee has no basis to consider granting land use right certificates to these households according to current regulations.

During the working session, Chairman of the Provincial People's Committee Le Hong Vinh received citizen Pham Thi Hanh, representing her mother, Nguyen Thi Hoi, from Xuan Binh block, Nghi Duc ward, Vinh city.
Accordingly, on December 23, 2024, Ms. Nguyen Thi Hoi submitted a petition to the Vinh City People's Committee stating: Her family owns plot number 170, sheet 1 (now plot 114, sheet 3) in Xuan Binh hamlet, Nghi Duc commune. The land plot's land use originated before December 18, 1980, and the Nghi Duc Commune People's Committee had received the application for land use conversion and re-recognition of the land area before 1980. The processing was completed in March 2024, but due to personal reasons, she did not submit the application to the Vinh City People's Committee for processing before August 1, 2024. She now requests that the application be processed according to the transitional provisions of the 2024 Land Law.
Make full use of legal provisions to ensure the rights of citizens.

At the citizen reception session, leaders of the Vinh City People's Committee and relevant departments and agencies such as the Department of Natural Resources and Environment, the Department of Construction, the Provincial People's Committee, and the Provincial Bar Association, based on legal regulations, discussed related issues and proposed solutions to address the citizens' requests.

Regarding the case of Ms. Tran Thi Lien, Hung Dung ward, Vinh city, Director of the Department of Natural Resources and Environment Hoang Quoc Viet stated that, based on legal regulations, in order to address the citizen's request, it is necessary to issue a Certificate of Land Use Rights to the citizen in cases of land allocation exceeding authority, in accordance with Conclusion Notice No. 263 dated April 18, 2023, of the Vice Chairman of the Provincial People's Committee Nguyen Van De on resolving difficulties in cases such as the 20C Garment Factory residential area.

Regarding the case of Ms. Nguyen Thi Hoi, residing in Xuan Binh block, Nghi Duc ward, Vinh city, based on legal regulations and explanations from relevant departments and agencies, there is currently no basis for implementation, including applying the transitional provisions of the 2024 Land Law to process her application.
To address the citizens' petition, the Director of the Nghe An Department of Natural Resources and Environment requested the Vinh City People's Committee and the citizens to review the origin of land use to confirm whether or not any of the following documents exist: a temporary land use right certificate issued by a competent state agency, or being listed in the Land Registry, Cadastral Register, or Land Survey Register compiled before December 18, 1980, containing the name of the land user;…

If one of the documents is available, and the land use limit is re-recognized, then this case can be applied. If the above documents are not available, it cannot be applied, regardless of the Land Law 2013 or the Land Law 2024, to reissue the Certificate of Land Use Rights.
Concluding the citizen reception session, Chairman of the Nghe An Provincial People's Committee Le Hong Vinh affirmed the principle of applying all legal regulations to protect citizens' rights and requested relevant levels and sectors to thoroughly implement them.

Specifically, regarding the case of Ms. Tran Thi Lien, Hung Dung ward, Vinh city, the Chairman of the Provincial People's Committee shared his understanding of the difficulties she faces living in the old residential area, as well as her wishes and needs to be allocated land without going through an auction.
The favorable aspect of the process is that the Ministry of National Defense has handed over the land to the province, and the province has planned the area as residential land. Based on this, the Chairman of the Provincial People's Committee agrees with the viewpoint expressed in Conclusion Notice No. 263 dated April 18, 2023, by the Vice Chairman of the Provincial People's Committee, Nguyen Van De, and the proposed solution by the Director of the Department of Natural Resources and Environment.
Based on that, the head of the Nghe An Provincial People's Committee instructed the city to continue reviewing both the relevant subjects and procedures to ensure compliance with current regulations. By the end of March 2025, a specific plan and roadmap must be finalized and reported to the Provincial People's Committee to resolve difficulties and obstacles for the households. The Chairman of the Provincial People's Committee also requested the 20C Garment Factory to conduct a safety review of the residential area to ensure the safety of the residents living there.
Regarding the case of Ms. Nguyen Thi Hoi, from Xuan Binh block, Nghi Duc ward, Nghe An Provincial People's Committee Chairman Le Hong Vinh explained in detail why there was no basis for resolving the matter under the transitional provisions of the 2024 Land Law. The crux of the matter is that the family must provide the documents required by law, as pointed out by the head of the Department of Natural Resources and Environment.
Based on that, the Chairman of the Provincial People's Committee requested citizen Pham Thi Hanh to explain the situation to her mother, Nguyen Thi Hoi, and her family; and at the same time, instructed relevant levels and sectors to coordinate and provide maximum support to her family in finding and providing the relevant documents for processing.
