On January 16th, the Hanoi City People's Court opened the first-instance trial of a case involving abuse of position and power while performing official duties, resulting in the loss of 1.1 billion VND of state budget funds.

At the trial, the defendant Do Xuan Duc (66 years old, residing in Xuan Phu commune, Phuc Tho district, Hanoi) was the Chairman of the People's Committee of Xuan Phu commune from 2006 to 2011. During his tenure, Duc colluded with Tran Van Mo (65 years old, residing in Ha Bang commune, Thach That district, Hanoi), Director of Bac Phuong Co., Ltd., to falsify documents and withdraw more than 1.1 billion VND from the state budget.
According to the indictment of the Hanoi People's Procuracy, in late 2008, in order to obtain funds for the construction of a communal house for Xuan Dong village, Duc abused his position and authority to organize the construction of the Xuan Dong village communal house before the Chairman of the Phuc Tho District People's Committee approved the economic and technical report, design drawings, total cost estimate, and bidding plan for the Xuan Dong village community cultural center.
Dục's criminal behavior is clearly demonstrated in his signing of a fictitious construction contract for the Xuân Đông village community cultural center, creating an acceptance report with Mơ to withdraw state construction support funds, and misusing them, causing a loss of over 1.1 billion VND.
Although Mơ did not directly participate in the construction of the Xuân Đông village community cultural center, she abused her position as director of the company to collude with Dục in creating fictitious construction contracts and acceptance reports to embezzle over 1.1 billion VND from the state.
The investigating agency determined that in this case, Duc played the main role, while Mo was an accomplice who assisted Duc in committing the crime. The investigation also determined that Mr. Nguyen Van Manh, the Party Secretary of Xuan Phu commune, participated in the meeting and agreed to the construction of the Xuan Dong village community cultural center.
During the construction process, Mr. Manh was irresponsible in failing to regularly inspect and supervise, leading to the consequences. However, the investigating agency determined that Mr. Manh's actions did not warrant criminal prosecution and therefore submitted a document to the Phuc Tho District Party Committee requesting disciplinary action against him within the Party.
At the end of the trial, the panel of judges sentenced defendant Duc to 30 months in prison and defendant Mo to 18 months in prison (suspended sentence) for the crime of abusing their position and authority while performing their official duties, as stipulated in Clause 2, Article 281 of the Penal Code.
