Is it permissible to transfer land that is currently being used by someone else to another person?

Article 117 of the 2024 Land Law stipulates:

The decision to allocate or lease land currently under someone's management or use to another party can only be made after the competent state agency decides to reclaim the land and after compensation, support, and resettlement have been completed in accordance with the law, except in cases where real estate projects are transferred in accordance with the law on real estate business.
