Is it necessary to submit a land survey extract when applying for a land title certificate?
My younger sibling is applying for a land ownership certificate for the first time, but they say the commune officials require a land survey map before they will accept the application. Is this correct or incorrect? (Question from Mr. Hoang Nghia Son, Dai Hue commune, Nghe An province)
Reply:According to the regulations in Section II, Point C, Part V, Appendix I of Decree 151/2025/ND-CP, this document is not a mandatory component of the dossier; instead, the People's Committee of the commune must "Extract the cadastral map for areas where a cadastral map already exists."
For areas without cadastral maps, and where "the application file for land use rights and ownership of assets attached to the land already includes a cadastral map extract, the cadastral map extract shall be checked and signed according to regulations." However, "in cases where the application file for land use rights and ownership of assets attached to the land does not include a cadastral map extract, a surveying unit with a license for surveying and cadastral mapping activities shall be requested to carry out the cadastral map extraction."
Therefore, a cadastral map extract of the land parcel is not always necessary, and even if it is, it is not a mandatory document component. It is only submitted by the land user if available; otherwise, the commune-level People's Committee is responsible for requesting a surveying unit with a license for cadastral surveying and map creation to carry out the cadastral map extract.
