List of goods prohibited from export and import.
The government has recently issued Decree 292/2026/ND-CP dated July 22, 2026, detailing certain provisions and measures for organizing and guiding the implementation of the Law on Foreign Trade Management. One of the notable contents of the Decree is the regulation on goods prohibited from export and import.
Specifically, Article 5 of Decree No. 292/2026/ND-CP on goods prohibited from export and import stipulates as follows:
1. Goods prohibited from export and import shall be implemented in accordance with the provisions of current legal documents and the List of Goods Prohibited from Export and Import specified in Appendix I of this Decree.
2. Based on Appendix I of this Decree and current legal documents, the Minister or Head of a Ministry-level agency is responsible for publishing details of goods prohibited from export and import, along with their HS codes, except in cases where current laws already provide detailed HS codes for these goods.
Goods prohibited from export and import as stipulated in Appendix I of this Decree are goods with HS codes and detailed descriptions belonging to the detailed list published by the Minister or Head of a Ministry-level agency.
3. The permission to export and import goods prohibited from export and import as stipulated in Clause 2, Article 10 of the Law on Foreign Trade Management and Clause 1, Article 28 of Government Decree No. 146/2025/ND-CP on decentralization and delegation of authority in the industrial and commercial sectors shall be implemented in accordance with Clauses 4 and 5 of this Article. If necessary, the Minister or Head of a Ministry-level agency shall issue a legal document specifying the details of licensing for export and import goods as stipulated in this Clause.
4. The documents for permitting the export and import of goods prohibited from export or import as stipulated in Clause 3 of this Article include:
a) Application for export or import of goods prohibited from export or import, using form No. 01 as prescribed in Appendix VII of this Decree or using the form prescribed by the Minister or Head of a competent ministerial-level agency (if any): 01 original copy.
b) Documentation detailing the plan for use, the process for managing exported and imported goods during use, and the plan for handling exported and imported goods after use: 01 original copy.
c) Report on the implementation status of previously issued licenses (if any): 1 original copy.
d) Other documents and papers as prescribed by the Minister or Head of a Ministry-level agency with authority to manage (if any).
5. Procedures for granting export and import licenses for goods prohibited from export and import as stipulated in Clause 3 of this Article.
a) Traders submit applications for export and import licenses for goods prohibited from export or import as stipulated in Clause 4 of this Article to the licensing authority.
b) If the application is incomplete or does not comply with regulations, within 3 working days from the date of receipt of the application, the licensing authority shall notify the business entity to complete the application.
c) Within 05 working days from the date of receiving a complete and valid application, the licensing authority shall issue a license to the trader exporting or importing goods. In case the license is not issued, the licensing authority shall provide a written response stating the reasons.
d) The licensing authority shall specify the validity period of the permit allowing traders to export or import goods in each case.
6. The period for storing and using in Vietnam goods prohibited from import as stipulated in Clause 3 of this Article shall be in accordance with the registration of the trader with the licensing authority, but shall not exceed 2 years.
7. Traders licensed to export and import as stipulated in Clause 3 of this Article are responsible for submitting a report using form BC01 as prescribed in Appendix VII of this Decree to the licensing authority no later than December 31st of each year on the situation of export, import, use of goods and handling of goods after use.
Importation of goods produced through forced labor is prohibited.
Appendix I of Decree No. 292/2026/ND-CP specifies the list of goods prohibited from export and import.
The list of prohibited export goods includes items such as: weapons, ammunition, explosives; round timber and sawn timber of all kinds from domestic natural forests; rough diamonds prohibited from export according to the Kimberley Process Certification Regulations; electronic cigarettes, heated tobacco products, etc.
The list of prohibited imported goods includes: Weapons, ammunition, explosives; fireworks of all kinds (except maritime safety flares as guided by the Ministry of Construction), sky lanterns, devices that interfere with vehicle speed measuring devices; electronic cigarettes, heated tobacco; used consumer goods; used vehicles (including the following groups: a) Textiles, footwear, clothing; b) Electronics, refrigeration, household appliances; c) Interior decoration items; d) Household goods made of ceramics, earthenware, glass, metal, plastic, rubber, and other materials; e) Bicycles, motorcycles, motorbikes); used medical equipment; used digital technology products...
In particular, the Decree also prohibits the import of products and goods that are exploited, produced, or manufactured wholly or partly by forced labor from enterprises, countries, or territories in accordance with relevant international treaties to which the Socialist Republic of Vietnam is a party.
