Reply:To establish a defense land use plan, it is necessary to base on Article 68 of the 2024 Land Law, which stipulates as follows:
Defense land use planning, security land use planning.
1. National defense land use planning and security land use planning are national sectoral planning.
2. The basis for making national defense land use planning and security land use planning includes the basis according to the provisions of the law on planning and the following bases:
a) National master plan, national marine spatial planning, national land use planning;
b) Natural, economic and social conditions of the country;
c) Current status of land use and results of implementation of national defense land use planning and security land use planning in previous periods;
d) Demand and ability to use land for national defense and security.
3. The content of national defense land use planning and security land use planning shall comply with the provisions of law on planning.
4. The Ministry of National Defense and the Ministry of Public Security shall preside over and coordinate with the provincial People's Committees in the process of formulating national defense land use plans and security land use plans to ensure compliance with the requirements of socio-economic development and strengthening national defense and security; review and determine the location, area, and boundaries of land used for national defense and security purposes; determine the location, area, and boundaries of national defense and security land that is no longer needed for handover to local authorities for management and use.
Thus, according to the above regulations, to establish a national defense land use plan, it is necessary to base on the provisions of the law on planning and the following bases:
National master plan, national marine spatial plan, national land use plan; National natural, economic and social conditions; Current land use status and results of implementation of national defense land use plan, security land use plan in previous period; Demand and ability to use national defense and security land.
