Proposal to prosecute and try Dao Minh Quan and his accomplices in absentia

The Ministry of Public Security's Security Investigation Agency (SISA) has issued an investigation conclusion and transferred the case file to the Supreme People's Procuracy, requesting prosecution and trial in absentia of Dao Minh Quan and his accomplices for terrorism against the people's government; activities aimed at overthrowing the people's government occurred in Ho Chi Minh City and several other provinces and cities.

On September 22, 2025, the Ministry of Public Security's Investigation Security Agency issued Investigation Conclusion No. 19/BKL-ANĐT concluding the investigation, transferring the case file to the Supreme People's Procuracy, requesting prosecution and trial in absentia of the leaders and key members of the organization "Provisional National Government of Vietnam" including Dao Minh Quan (born July 27, 1952; Hometown: Ky Huong, Tam Ky, Quang Nam; current residence: PO BOX 2807 ANAHEMIM, CA 92814, USA; Nationality: USA; Role in the organization: Self-proclaimed "Prime Minister" of the organization "Provisional National Government of Vietnam") and 4 accomplices including: Pham Lisa, Dao Kim Quang, Huynh Thi Tham, Lam Ai Hue for the crime of "Terrorism against the people's government" prescribed in Clause 1, Article 113 of the Penal Code and the crime of "Activities aimed at overthrowing the people's government" prescribed in Clause 1, Article 113 of the Penal Code. 1, Article 109, Penal Code; propose to prosecute and try 19 defendants in the country for the crime of "Activities aimed at overthrowing the people's government" as prescribed in Clause 1, Article 109 of the Penal Code.

The Ministry of Public Security's Investigation Security Agency has publicly posted procedural documents on the investigation, wanted notice, investigation conclusion, request for prosecution, and trial in absentia against Dao Minh Quan, Pham Lisa, Dao Kim Quang, Huynh Thi Tham, and Lam Ai Hue according to the provisions of the 2015 Criminal Procedure Code (amended and supplemented in 2025) and Joint Circular No. 05/2025/TTLT-BCA-BQP-VKSNDTC-TANDTC dated July 1, 2025 of the Ministry of Public Security, the Ministry of National Defense, the Supreme People's Procuracy, and the Supreme People's Court.

The Ministry of Public Security's Investigation Security Agency calls on Dao Minh Quan, Pham Lisa, Dao Kim Quang, Huynh Thi Tham, and Lam Ai Hue to quickly surrender to enjoy the leniency of the law and exercise their right to defense as prescribed in Article 60 of the Criminal Procedure Code. If they do not appear or surrender, they will be considered to have waived their right to self-defense and will be tried in absentia according to the procedures prescribed in the 2015 Criminal Procedure Code (amended and supplemented in 2025) and Joint Circular No. 05/2025/TTLT -BCA-BQP-VKSNDTC-TANDTC dated July 1, 2025 of the Ministry of Public Security, the Ministry of National Defense, the Supreme People's Procuracy, and the Supreme People's Court.

The organization "Provisional National Government of Vietnam" is a terrorist organization. Any act of participating, propagating, attracting, inciting others to participate, sponsoring, receiving sponsorship from the organization "Provisional National Government of Vietnam", participating in training courses, "referendums" organized by the organization "Provisional National Government of Vietnam", operating under the direction of members of the organization "Provisional National Government of Vietnam"... will be considered and handled according to the provisions of Vietnamese law.

It is recommended that people raise awareness of the plots, tricks, and sabotage activities of hostile forces; heighten vigilance against fabricated, distorted, and false allegations of reactionary subjects and bad elements on cyberspace about the Party's guidelines and policies, the State's policies and laws; absolutely do not participate in demonstrations, activities that disrupt security and order, do not participate in reactionary and terrorist associations, groups, and organizations, and do not share on social networks bad, toxic, unverified information that is not from official sources from radio, newspapers, and electronic information pages of the Central and local governments.

When discovering acts of propaganda and opposition activities of the "Provisional National Government of Vietnam", immediately report to the nearest police agency for timely prevention and handling measures.
