The Central Disciplinary Committee has requested the Politburo and the Central Committee of the Party to consider and impose disciplinary measures against Comrade Dinh La Thang in accordance with their authority.

From April 24 to 26, 2017, the Central Inspection Committee held its 14th session in Hanoi. Comrade Tran Quoc Vuong, Member of the Political Bureau, Secretary of the Central Committee of the Party, and Chairman of the Central Inspection Committee, presided over the session.

At this meeting, the Central Inspection Committee (CIC) considered and concluded on the following matters:

I. Regarding the investigation into suspected violations and consideration of disciplinary action against the Standing Committee of the Party Committee of the Vietnam National Petroleum Group and some related individuals.

1- Standing Committee of the Group's Party CommitteeDuring the period of 2009-2015, Vietnam National Petroleum Corporation (PVN) showed a lack of responsibility in leadership and direction, neglecting inspection, supervision, and management of Party organizations and members; failing to inspect, review, and handle the responsibilities of many cadres and leaders of subordinate units who committed violations and shortcomings, allowing units operating inefficiently and incurring losses for many years to still be transferred, rotated, and appointed by the Corporation, in some cases to higher positions; allowing many cadres to seriously violate Party discipline and state laws, resulting in expulsion from the Party and criminal prosecution, including key leaders of the Corporation. It also failed to strictly comply with the Prime Minister's directives regarding the review of responsibility for the serious losses incurred by the Vietnam Oil and Gas Construction Joint Stock Corporation (PVC).

Irresponsible in advising the Party Committee of the Group to issue Resolution No. 233/NQ-DU, dated August 17, 2009, which contained provisions inconsistent with the law and contrary to the directives of the Prime Minister, leading to the Board of Members, the General Directorate of the Group, and member corporations deciding to award many contracts illegally.

The Board of Directors issued resolutions and decisions designating numerous large-value contracts, violating government decrees; and advised and proposed to the Prime Minister the designation of many contracts that did not meet the conditions stipulated by law.

Irresponsibility and lax leadership in the management and use of capital and assets, and in the implementation of investment projects, led to very serious violations by the Board of Directors and some member units, resulting in the loss of nearly 900 billion VND in investment capital; including a loss of 800 billion VND in capital contributions to OceanBank.

The Board of Directors issued Resolution No. 4266/NQ-DKVN, dated May 16, 2011, to invest capital in OceanBank exceeding the prescribed limit, in violation of the Law on Credit Institutions, causing very serious damage to the Group.

Many of the Group's investments have suffered losses, posing a significant risk of not recovering the invested capital.

The Central Committee of the Communist Party of Vietnam's Inspection Commission proposes that the Politburo and the Central Committee of the Party consider and impose disciplinary measures against Comrade Dinh La Thang according to their authority.

ComradeDinh La Thang, Member of the Politburo, Secretary of the Ho Chi Minh City Party Committee, former Secretary of the Party Committee, former Chairman of the Board of Directors of PVN Group, is held responsible as the head for the violations and shortcomings of the Standing Committee of the Party Committee and the Board of Directors of PVN Group during the period 2009 – 2011.

Responsible for signing and issuing Resolution 233/NQ-ĐU, dated March 17, 2009, of the Group's Party Committee, which contained provisions inconsistent with legal regulations, leading the Board of Directors, the Group's General Directorate, and member corporations to illegally award numerous contracts through direct negotiation;

Violation of the Board of Directors' Rules of Procedure in signing the agreement to participate in capital contribution in Document No. 6934, dated September 18, 2008, between Mr. Dinh La Thang, Chairman of the Board of Directors of the Group, and the Chairman of the Board of Directors of Oceanbank (with the content: the Group participates in contributing 20% ​​or more of the capital; appoints personnel to participate in management and operation; requests member units to use Oceanbank's services) before the Board of Directors of the Group met to unanimously agree on the above content.

Responsible for the Board of Directors issuing Resolution No. 4266/NQ-DKVN on contributing capital to OceanBank exceeding the prescribed limit, contrary to the Law on Credit Institutions, causing very serious damage to PVN.

Responsible for the Board of Directors issuing several resolutions and decisions designating numerous large-value contracts, violating government decrees; advising and proposing to the Prime Minister the designation of many contracts that did not meet the conditions stipulated by law.

Approving PVC's exemption from performance guarantee requirements for projects assigned to PVC by the Group, and approving PetroVietnam Technical Services Corporation (PTSC)'s exemption from performance guarantee requirements for the Engineering, Procurement, and Construction (EPC) contract for the Dung Quat Biofuel Plant, violates the 2005 Bidding Law.

Comrade [Name] is responsible for issuing policies and investment decisions that were scattered and fragmented; lacking inspection and supervision of the implementation process of projects during the period when Comrade [Name] was the Group leader, leading to low investment efficiency; some projects had to be stopped, delayed, or postponed, resulting in prolonged losses, causing waste, loss of investment capital, and very serious consequences (including the Dinh Vu Polyester Fiber Production Plant Project and biofuel projects).

3. ComradePhung Dinh ThucFormer Deputy Secretary of the Party Committee, member of the Board of Directors and General Director of PVN from 2008-2010, and Secretary of the Party Committee and Chairman of the Board of Members from September 2011 to July 2014, is held responsible as the head for the violations and shortcomings of the Standing Committee of the Group's Party Committee during the 2011-2014 period; responsible for the issuance of Resolution 233/NQ-ĐU of the Party Committee and Resolution 4266/NQ-DKVN of the Board of Members, causing very serious consequences. Violations in organizational and personnel work, lack of responsibility in making incorrect assessments of Trinh Xuan Thanh when he transferred to the Ministry of Industry and Trade; failure to direct the review of violations by Nguyen Xuan Son while he was General Director of Oceanbank; He is jointly responsible with the Standing Committee of the Party Committee and the Board of Directors for the process of proposing to the competent authority the appointment of Nguyen Xuan Son from Deputy General Director to Chairman of the Board of Directors and Secretary of the Party Committee of the Group in 2014. He is also responsible for the shortcomings and violations at the Dinh Vu Polyester Fiber Production Plant Project and the biofuel projects.

4. ComradeDo Van HauHe, former Deputy Secretary of the Party Committee, Member of the Board of Directors, and General Director of PVN from November 2011 to October 2014, is jointly responsible for the violations and shortcomings of the Standing Committee of the Group's Party Committee during the aforementioned period. He is responsible for the issuance of Resolution 233/NQ-ĐU of the Party Committee and Resolution 4266/NQ-DKVN of the Board of Directors, which caused very serious consequences. He lacked responsibility in making inaccurate comments about Trinh Xuan Thanh and Vu Dinh Duy when they transferred to other positions; he is responsible for proposing the appointment of Nguyen Xuan Son as mentioned above. He is responsible for the shortcomings and violations related to the Dinh Vu Polyester Fiber Production Plant Project and the Biofuel projects.

5. Mr.Nguyen Xuan SonMr. Nguyen Xuan Son, former Party Secretary and Chairman of the Board of Directors of PVN Group, is responsible for the violations and shortcomings of the Standing Committee of the Group's Party Committee during the 2010-2015 term. He is responsible for the issuance of Resolution 233/NQ-DU of the Party Committee and Resolution 4266/NQ-DKVN of the Board of Directors, which caused very serious consequences. During his time as General Director and representative of PVN's capital at Oceanbank, Mr. Nguyen Xuan Son abused his position and authority while performing his duties, intentionally violating State regulations on economic management, causing very serious consequences. Currently, Mr. Nguyen Xuan Son is being held in temporary detention by the Police Investigation Agency - Ministry of Public Security for investigation and prosecution in accordance with the law.

6. ComradeNguyen Quoc KhanhThe former Party Committee Secretary, Chairman of the Board of Directors, former member of the Standing Committee of the Party Committee, and former Deputy General Director are jointly responsible for the violations and shortcomings of the Group's Party Committee Standing Committee during the 2010-2015 term; responsible for the issuance of Resolution 233/NQ-ĐU of the Party Committee and Resolution 4266/NQ-DKVN of the Board of Directors. They are responsible for advising on the decision to award the EPC contract for the Long Phu 1 Thermal Power Plant and the Thai Binh 2 Thermal Power Plant in violation of the law, causing serious consequences. They are also responsible for the shortcomings and violations at the Dinh Vu Polyester Fiber Production Plant Project and the Biofuel projects.

The violations and shortcomings of the Standing Committee of the PVN Party Committee and the individuals mentioned above are very serious, negatively affecting the prestige of the party organization and the individuals involved. Based on Regulation No. 263-QĐ/TW and Regulation No. 181-QĐ/TW of the Politburo on handling violations by party organizations and party members, the Central Inspection Committee decides:

- Dismissing Comrade Phung Dinh Thuc from his position as Secretary of the Party Committee of PVN Group for the 2010-2015 term; dismissing Comrade Do Van Hau from his position as Deputy Secretary of the Party Committee of PVN Group for the 2010-2015 term; expelling Mr. Nguyen Xuan Son from the Party; and issuing a warning to Comrade Nguyen Quoc Khanh.

- We propose that the Politburo and the Central Committee of the Party consider and impose disciplinary measures against Comrade Dinh La Thang according to their authority.

- We request that the Party Committee of the Ministry of Industry and Trade urgently consider appropriate administrative disciplinary measures against the individuals mentioned above.

- The Party Committee of the Central Business Bloc is requested to promptly take disciplinary action against the Standing Committee of the Party Committee of PVN Group.

II- Considering disciplinary action against Comrade Nguyen Van Thien, former Member of the Central Committee of the Party, former Secretary of the Provincial Party Committee, and Comrade Le Huu Loc, former Deputy Secretary of the Provincial Party Committee, former Chairman of the People's Committee of Binh Dinh Province.

1. Comrade Nguyen Van Thien, in his capacity as a member of the Central Committee of the Party and Secretary of the Provincial Party Committee for the 2010-2015 term, is responsible for the violations and shortcomings that occurred in the process of supplementing the planning and appointing some cadres who did not meet the required conditions and standards and were not in accordance with regulations.

2. Comrade Le Huu Loc, in his capacity as Deputy Secretary of the Provincial Party Committee, Secretary of the Party Committee of the Provincial People's Committee, and Chairman of the Provincial People's Committee during the 2011-2016 term, is responsible for the violations and shortcomings that occurred in the recruitment and salary classification of civil servants in violation of regulations.

Based on Decision No. 181-QD/TW of the Politburo on disciplinary action against Party members who violate regulations, the Central Inspection Committee decides:

- Disciplinary action in the form of a reprimand is being taken against Comrade Le Huu Loc.

- We propose that the Party Central Committee take disciplinary action against Comrade Nguyen Van Thien in accordance with its authority.

- We request that the Standing Committee of Binh Dinh province and Comrade Le Kim Toan, Permanent Deputy Secretary of the Provincial Party Committee, conduct a thorough and serious self-criticism regarding the related shortcomings.

III- Review the report on the results of the Party's financial audit of the Standing Committee of the Lai Chau Provincial Party Committee; provide opinions on several draft documents to be submitted to the Politburo and the Secretariat on Party inspection, supervision and disciplinary enforcement; and resolve other matters within its authority.
