Proposal to add leadership positions to be served by private jet flights.

The Ministry of Justice has just released the assessment document for the draft decree on ensuring the safety of special flights and private cabins. The draft document was prepared under the leadership of the Ministry of Construction.

Essentially, the content of the draft decree inherits the provisions of the current decree and circular.

However, the draft decree omits the following concepts: VIP flights; VIP flights; VIP flights and VIP flights of Vietnam; and VIP flights of foreign countries.

The Ministry of Construction stated that the omission of these concepts was due to their inclusion in the draft decree on aviation security, aiming to ensure there are no overlapping or redundant regulations regarding special flights and special cabins, while also facilitating consistent reference, application, and regulation.

The draft decree proposes specific regulations stipulating that high-ranking Party and State leaders will be served by private flights, including: the General Secretary, the President, the Prime Minister, the Chairman of the National Assembly, and the Standing Committee of the Party Central Committee.

The draft decree, which includes a provision allowing the Standing Committee of the Party Central Committee to be served by special flights and private cabins, aims to ensure consistency with the 2017 Law on Security Guarding, as amended and supplemented in 2025, and other relevant legal regulations.

In addition, the draft decree supplements regulations on ensuring security for special flights and charter flights of Vietnam, and ensuring security for special flights of foreign countries to and from Vietnam, in compliance with the Decree on Aviation Security.

The addition of these regulations aims to ensure consistency with the 2025 Vietnamese Civil Aviation Law, which assigns the state management function regarding aviation security to the competent authority under the Ministry of Public Security. This is necessary to ensure the legal basis for organizing and implementing security measures for special flights and charter flights under conditions where the organizational structure and assignment of responsibilities for state management are changing.

To ensure proactiveness, timeliness, and effectiveness in organizing and implementing tasks related to VIP and VIP flights, the draft decree specifies the responsibilities of specialized agencies and units under ministries and sectors directly involved in the organization, operation, and service process.

Accordingly, the draft decree sets out direct tasks for specialized agencies such as: the Consular Department, the State Protocol and Foreign Translation Department under the Ministry of Foreign Affairs; the Operations Department, Air Defense - Air Force Command under the Ministry of National Defense; the Guard Command and the Immigration Department under the Ministry of Public Security; the Civil Aviation Authority of Vietnam, the Airport Authority under the Ministry of Construction and related aviation service providers (Regional Air Traffic Management Company, Air Traffic Flow Management Center, Aviation Information Center).

The purpose of specifying the direct responsibilities of the aforementioned agencies is to maintain the stability of regulations that have been effectively implemented, in accordance with the functions, tasks, powers, and current organizational structure of ministries and sectors; ensuring continuity and smooth operation in leadership and management.

At the same time, assigning this task also shortens the coordination process, enhances the proactiveness and responsibility of the agencies directly implementing the task; ensuring close inter-agency coordination to guarantee absolute security and safety for special flights and chartered aircraft.
