Killed brother for not attending his grandchild's full month party
Seeing that his brother did not attend his grandson's full-month party, Bui Van Thuan took a knife to his house to ask why. When he heard his brother answer that he was busy, Thuan stabbed his brother to death on the spot.
On December 30, Nghe An Provincial People's Court opened a trial for defendant Bui Van Thuan (born 1964), residing in Vien Thanh commune, Yen Thanh district, aboutmurderThe victim in the case is the defendant's brother - Mr. Bui Van H. (born in 1950).
The indictment stated that on the evening of May 13, 2024, Thuan's family held a full-month party for their grandson. After the party, Thuan did not see Mr. H. so he rode his motorbike to his brother's house to ask what was going on. Before entering his brother's house, Thuan opened the motorbike trunk, took out a sharp knife and put it behind his pants.
Seeing his brother lying on a hammock in front of the house, Thuan asked why he didn't come to the baby's first month party. When Mr. H. answered that he was busy, Thuan thought his brother looked down on his family, so he pulled out a knife and stabbed Mr. H. many times in the face, shoulder, neck, and chest.
At that time, Mr. H.'s grandson was washing dishes and witnessed the incident, so he ran to the neighbor's house to call for help. Immediately after, two neighbors, Mr. Nguyen Vinh B. (born in 1956) and Ms. Bui Thi Th. (born in 1980) rushed over.
Seeing Thuan holding a knife, Ms. Th. ran over, grabbed his shirt and pulled him away, and was stabbed in the back. Mr. B. came to stop him and was also stabbed in the stomach by Thuan.
Then, Thuan turned back and saw Mr. H. sitting on the hammock, so he continued to run and stab him many times. As a result, Mr. Bui Van H. died on the spot. The cause of death was circulatory and respiratory failure due to a wound that punctured the heart and lungs.
As for the perpetrator, after committing the crime, Bui Van Thuan fled to Nghia Dan district (Nghe An). The next morning, the perpetrator was arrested by the police.
At the witness stand, the defendant admitted to the crime. The defendant said that he was angry that his brother did not attend his nephew's full-month party, so he went to the house to ask what happened.
"When my uncle said 'I'm busy and can't come, you watch the guests', the defendant got angry and stabbed his brother," the defendant admitted to stabbing the person but did not remember how many times he stabbed him.
In the presence of the victim's legal representative and many relatives, brothers, and children, the defendant bowed his head and apologized.
The legal representative of the victim attended the court and requested the panel of judges to handle the defendant according to the law. The two remaining victims filed a petition to reduce the defendant's sentence.
The panel of judges determined that the defendant’s actions constituted murder. In this case, the fact that the defendant committed the crime to the end is an aggravating factor. However, it is also necessary to consider mitigating factors for the defendant, such as his honest confession, his family’s efforts to remedy the consequences for the two victims, and his participation in the war to protect the Fatherland…
Considering the case as a whole, the court sentenced Bui Van Thuan to life in prison for murder. As for the civil part, because the two parties agreed on it, the court did not consider it.
