Subjects assigned protective forest land for management according to the 2024 Land Law

Reply:

The subjects assigned by the State with protective forest land for management, use, protection and development of forests are stipulated in Article 185 of the 2024 Land Law as follows:

1. The State allocates protective forest land for management, use, protection and development of forests in accordance with the provisions of forestry law to the following subjects:

a) Management boards of protective forests, management boards of special-use forests, units of the people's armed forces;

b) Economic organization for protective forest land interspersed within the production forest land area of ​​that organization;

c) Individuals legally residing in the commune where there is a protective forest;

d) Residential communities in communes where there are protective forests.

2. The subjects assigned by the State with protective forest land as prescribed in Clause 1 of this Article are allowed to construct infrastructure works to serve forest management, protection and development in accordance with the provisions of the law on forestry.

3. Persons to whom the State allocates land as prescribed in Clause 1 of this Article shall be granted a Certificate of land use rights and ownership of assets attached to land, but shall not have their assets recorded as public assets on the Certificate of land use rights and ownership of assets attached to land.

4. Persons granted Certificates of land use rights and ownership of assets attached to land as prescribed in Clause 3 of this Article, except for protective forest management boards and special-use forest management boards, may exercise the rights of land users and must ensure compliance with the provisions of Clause 8, Article 45 of this Law.
