The application of AI-integrated surveillance cameras in detecting traffic violations has yielded significant results. Recently, images released by the Traffic Police Department show many drivers violating regulations such as not wearing seat belts, carrying more passengers than allowed, and especially using mobile phones while driving.
According to statistics, 126 drivers have been fined for using their phones while driving. This raises a question in the community: is using a phone while stopped at a red light considered a traffic violation?
Legal regulations regarding the use of mobile phones while driving.
To clarify this issue, it is necessary to consider current legal regulations. According to point a, clause 4, Article 5 of Decree 100/2019/ND-CP, the act of using a mobile phone with one's hands while driving a car on the road will be fined from VND 2,000,000 to VND 3,000,000. In addition, the offender will also be subject to an additional penalty of suspension of their driver's license for 1 to 3 months.
For drivers of motorcycles and mopeds (including electric motorcycles), similar violations will be subject to a fine of VND 800,000 to VND 1,000,000 and suspension of their driver's license for 1 to 3 months, as stipulated in point h, clause 4, Article 6 of the same Decree.

The key point in these regulations is the phrase "while driving on the road." This means that the violation is only punishable when the vehicle is in motion.
Is stopping at a red light considered "driving"?
When a vehicle stops to wait for a traffic light, legally, it is not "driving on the road." This is a temporary stop at the request of the traffic signal, not a deliberate act of stopping or parking. Therefore, according to the wording of the law, the act of a driver using a phone while stopped at a red light does not fall under the scope of the penalty for the offense of "using a mobile phone with one's hands while driving on the road."
However, road users need to be extremely careful. Focusing on their phones can distract drivers, preventing them from observing traffic lights and moving when the light turns green. This action can obstruct traffic for vehicles behind, posing a risk of collision when traffic resumes.
Recommendations for general safety
Although not subject to penalties under the above regulations, the Traffic Police Department and traffic safety experts still advise drivers against using their phones while stopped at red lights. Even a few seconds of distraction can lead to unfortunate consequences.
In the event of an emergency call or message, the safest solution is for the driver to proactively find a safe place to stop and park to handle the matter. Additionally, equipping and using hands-free devices such as Bluetooth headsets is a sensible option, allowing the driver to stay connected while maintaining focus on observing and safely controlling the vehicle.
