The man senselessly beat his neighbor to death and then turned himself in to the police.
Believing his neighbor had repeatedly walked past his house, Tới used a wooden stick to beat him to death. After committing the crime, the killer surrendered to the police.
On November 25th, the People's Court of Nghe An province opened a trial to hear the case against defendant Nguyen Xuan Toi (born in 2004), residing in Son Hai commune, Quynh Luu district, for the crime of "murder".
According to the indictment, at approximately 4 PM on July 12, 2024, Nguyen Xuan Toi and his neighbor were sitting by the roadside when Mr. Thai Ba Nh. (born in 1954) walked by. Mr. Nh. stopped, chatted and joked with everyone, then left.
About 10 minutes later, Toi saw Mr. Nh. coming down towards him. Believing that Mr. Nh.'s repeated comings and goings in front of his house were annoying, Toi decided to assault Mr. Nh.
Tới immediately went into the alleyway of his neighbor's house and grabbed a long, round piece of wood. As Mr. Nh. approached, Tới used the wood to strike his neighbor repeatedly on the head and back. While striking, Tới kept saying, "I'm sorry, sir, I'm sorry." Even though the victim had fallen to the ground, Tới continued to strike him repeatedly, causing Mr. Nh. to die on the spot.
Only when people around him started shouting did Toi throw down his wooden stick and yell, "Someone's dead! Surrender! Go to the police station and turn yourself in!" After saying that, Toi raised both hands high and ran to the police station to surrender.
During the investigation, authorities determined that in 2020, Toi was involved in a traffic accident, suffering a traumatic brain injury and requiring hospital treatment. After returning to his hometown, Toi exhibited symptoms related to his illness.mental.
Subsequently, the Investigation Police Department of Nghe An Province decided to conduct a forensic psychiatric examination of Nguyen Xuan Toi, concluding that, before, during, and after committing the crime, Toi suffered from post-concussion syndrome, which limited his ability to perceive and control his behavior.
At the trial, the defendant admitted to the crime. He testified that he became angry because he saw the victim walking back and forth many times, and then he grabbed a piece of wood and beat the victim to death.
The defendant's mother stated that her son had previously suffered a traumatic brain injury and had an unstable mental state. After the incident, the defendant's family compensated the victim's family with 50 million VND.
In the presence of the victim's family, the defendant offered an apology, expressing remorse and regret.
Considering the defendant's actions constituted murder, the court sentenced Nguyen Xuan Toi to 15 years in prison. In terms of civil matters, the defendant was ordered to compensate the victim's family with 100 months' basic salary and 15 million VND for funeral expenses.
