Ha Van Tham claims he was deceived when he lent Pham Cong Danh 500 billion VND.
Testifying in court today, Ha Van Tham alleged that Pham Cong Danh had defrauded Oceanbank of its money.

On the afternoon of February 28, the trial of Ha Van Tham moved on to questioning defendant Ha Van Tham and convicted defendant Pham Cong Danh.
According to the allegations, Ha Van Tham was the mastermind and ringleader, committing violations of lending regulations in the operations of credit institutions.
Tham's actions were determined to be related to former VNCB Chairman Pham Cong Danh, causing nearly 500 billion VND in losses to Oceanbank.
In response to the question: Why were the assets of Trung Dung Company (backed by Pham Cong Danh) insufficient to secure the 500 billion VND loan, yet Tham still signed off on Oceanbank's disbursement of the money? - Ha Van Tham claimed he was deceived.

According to the defendant's statement, he did not discuss the loan with Ms. Hua Thi Phan (a major shareholder, representing the group of shareholders of Dai Tin Commercial Bank) and Mr. Danh.
"The claim that the defendant had prior agreement and discussion before accepting the loan application is incorrect. The defendant, Ms. Phan, and Mr. Danh only met once at a hotel and only discussed purchasing shares," Tham testified.
Tham explained that she lent Trung Dung Company 500 billion VND despite its charter capital being only 250 billion VND because she believed the company had high commercial value.
According to Tham's own assessment, Trung Dung Company's other assets, such as stocks and villas, could be sold for 250 billion VND. Adding the company's commercial value, this would provide collateral of over 700 billion VND, making it entirely possible to secure a loan.
Tham stated: "We assess the value of a business based on its revenue. Trung Dung Company has shares in Big C shopping mall, but it's leased and can sublease it at a good price."
When the defendant reviewed the files, Trung Dung Company had significant revenue from Big C shopping mall, wedding reception center, shares, and real estate including villas."
According to Ha Van Tham's testimony, despite the valuation, because Trung Dung Company's collateral was not secure, he requested the company to freeze 500 billion VND in assets at Dai Tin Bank.
This was an agreement between Oceanbank, Dai Tin Bank, and Trung Dung Company; it was essentially a credit guarantee. However, Dai Tin Bank subsequently failed to keep its commitment.
"About a year later, the defendant asked his brothers to check the money, and the account balance was still shown as full. This means that Dai Tin Bank and Trung Dung Company colluded to deceive the defendant," Thắm testified.
With this 500 billion VND loan, Tham admitted that she was the one responsible.
The takeover attempt failed.

According to Tham's testimony, because he wanted to take over several commercial banks for OceanBank, he met with Ms. Hua Thi Phan to discuss transferring Dai Tin Bank to him.
Tham sent her people to Dai Tin Bank to check, but they discovered a lot of bad debt, so they didn't buy the property and instead introduced it to Pham Cong Danh.
In response to questioning about this transaction, convicted defendant Pham Cong Danh testified that he wanted to acquire Dai Tin Bank because he had long harboured the ambition of establishing a bank specifically for the construction industry.
When Tham proposed buying Dai Tin Bank, Mr. Danh agreed after reviewing the documents. However, after further investigation, he discovered that the bank had an unimaginable amount of bad debt.
"At that time, I gave Mr. Tham 500 billion VND, and he promised to provide support. The 500 billion VND was to reimburse Mr. Tham for the expenses he incurred in taking care of customers," Mr. Danh testified.
According to Mr. Danh's testimony, this 500 billion VND is not related to the 500 billion VND that Tham had lent to Trung Dung company.
In response to the question: "You already have 500 billion VND, why borrow another 500 billion VND?", Mr. Danh replied: "I gave 500 billion VND so that Mr. Tham could transfer ownership of Dai Tin Bank to me. I had no intention of deceiving him, and I have already repaid Mr. Tham 500 billion VND."
