On the afternoon of February 28, the trial of Ha Van Tham moved on to questioning defendant Ha Van Tham and convict Pham Cong Danh.

According to the accusation, Ha Van Tham was the mastermind and leader, violating regulations on lending in the operations of credit institutions.

This behavior of Tham was determined to be related to former Chairman of VNCB Board of Directors Pham Cong Danh, causing damage to Oceanbank of nearly 500 billion VND.

Answering the question: Why was the assets of Trung Dung Company (behind by Pham Cong Danh) not enough to secure the loan of 500 billion VND, but Tham still signed for Oceanbank to disburse the above amount? - Ha Van Tham said he was deceived.

According to this defendant's statement, he did not discuss with Ms. Hua Thi Phan (major shareholder, representative of the shareholder group of Dai Tin Commercial Joint Stock Bank) and Mr. Danh about the loan.

"Other people saying that the defendant had an agreement and discussion before accepting the loan application is not true. The defendant, Ms. Phan and Mr. Danh only met once at the hotel and only talked about buying shares" - Tham stated.

Tham explained that he lent Trung Dung company 500 billion VND even though the company's charter capital was only 250 billion VND because he believed that the company had high commercial value.

According to Tham's own assessment, Trung Dung Company's other assets are stocks and villas that can be sold for 250 billion. Combined with the commercial value of this company, there will be a guarantee of more than 700 billion VND, so it is completely possible to lend.

Tham said: "Based on the revenue of that business to evaluate the value of the business. Trung Dung Company has shares in Big C shopping center, but it is rented and can be sublet at a good price.

When the defendant reviewed the records, Trung Dung company had large revenues from Big C shopping mall, wedding center, stocks and real estate including villas.

According to Ha Van Tham's testimony, despite the valuation, because Trung Dung Company's collateral was not tight, he asked the company to freeze 500 billion VND in assets at Dai Tin Bank.

This is a commitment between Oceanbank, Dai Tin Bank and Trung Dung Company, it is almost a credit guarantee. However, Dai Tin Bank later did not keep its commitment.

"About a year later, the defendant asked his brothers to check that amount of money, and the account balance was still reported as full. Thus, Dai Tin Bank and Trung Dung Company joined hands and agreed to deceive the defendant," Tham's testimony said.

With this 500 billion VND loan, Tham admitted that she was responsible.

According to Tham's testimony, because he wanted to acquire a number of commercial banks for OceanBank, he went to meet Ms. Hua Thi Phan to discuss transferring Dai Tin Bank to Tham.

Tham took her people to Dai Tin Bank to check and discovered that there were many bad debts, so she did not buy it but introduced it to Pham Cong Danh.

Responding to questioning about this deal, defendant Pham Cong Danh stated that he wanted to buy back Dai Tin Bank because he had long cherished the idea of ​​establishing a bank for the construction industry.

When Tham asked him to buy Dai Tin Bank, after reviewing the documents, Mr. Danh agreed. However, after investigating, he discovered that this bank had bad debts beyond imagination.

"At that time, I gave Mr. Tham 500 billion VND and Mr. Tham promised to support. The 500 billion VND was to pay back Mr. Tham for the cost of taking care of customers," Mr. Danh said.

According to Mr. Danh's statement, this 500 billion VND is not related to the 500 billion VND that Tham lent to Trung Dung company.

Answering the question: You already have 500 billion VND, why did you borrow 500 billion VND? - Mr. Danh replied: "I gave 500 billion VND so that Mr. Tham could transfer to me to buy Dai Tin Bank. I have no intention of cheating and have already returned 500 billion VND to Mr. Tham."
