(Baonghean.vn) - Hung Nguyen District People's Committee has just reported to the Provincial People's Committee on the review of the implementation of the high-tech Israeli tilapia farming project in Hung My commune of Synot Asean Joint Stock Company.
On September 21, 2022, the Provincial People's Committee issued Official Dispatch No. 809/VPUB-NN directingPeople's Committee of Hung Nguyen districtReview and report on the implementation of the high-tech Israeli tilapia farming project in Hung My commune, Hung Nguyen district, invested by Synot Asean Joint Stock Company. By October 14, 2022, the People's Committee of Hung Nguyen district had Report No. 427/BC-UBND sent to the Provincial People's Committee, with the following content:
Synot Asean Joint Stock Company was approved by the People's Committee of Nghe An province to invest in a high-tech Israeli tilapia farming project in Decision No. 2333/QD-UBND dated June 1, 2017, and approved the detailed construction planning at a scale of 1/500 in Decision No. 5704/QD-UBND dated November 24, 2017 with an area of 64,101m2.2, including items: Main gate; Side gate; 1-storey guard house, construction area 16.5m2;1-storey factory, construction area 450m2; 1-storey warehouse and auxiliary building, construction area 200m22; 3-storey office building, construction area 325m2; 2-storey worker's hostel, construction area 140m22; sports field, construction area 250m2; 1-storey garage, construction area 96m2; parking lot; 1-storey water plant, construction area 90m2; water filter tank, construction area 320m2; power station, construction area 20m2; 1-storey generator house, construction area 16m2; settling pit, area 2720m2; settling pond, area 2540m2; fish fry pond, area 1165m2; breeding pond, area 1,475m22; parent stock pond, area 2,145m2; fish breeding pond, area 17,715m2; 1-storey garbage collection house, construction area 16m2; 1-storey pump house, construction area 12m2; wastewater treatment tank area 84m2; drainage channel area 2,705m2Construction density 2.79%, building height from 1-3 floors.

Nghe An Provincial People's Committee leased land in Decision No. 91/QD-UBND dated December 7, 2018, granted a certificate of land use rights, house ownership rights and other assets attached to land with code CN 785495 dated May 24, 2019 to Synot Asean Joint Stock Company with a total area of 63,997.4m22(including: aquaculture land 55,238.8m2, commercial service land 8,758.6m2). On July 19, 2019, Synot Asean Joint Stock Company was granted Construction Permit No. 63GP/SXD by the Department of Construction of Nghe An province.
Regarding project implementation status:
After receiving land from the Department of Natural Resources and Environment, the investor proceeded with site clearance compensation (cost of nearly 5 billion VND) and paid a deposit.761 million VND, pay for protection and development of rice land 1.082 million VND, paid land rent in 2019 is 19.5 million VND and paid land rent for the entire lease term is 4,448.9 million VND. The investor (Synot Asean Joint Stock Company) has started construction of the project items.
11/6/2020, Hung Nguyen District People's Committee issued Decision No. 512/Decision No. 106/QD-UBND on the establishment of an interdisciplinary team to inspect and handle violations in land lease projects in Hung Nguyen district in 2020, including the high-tech Israeli tilapia farming project in Hung My commune, Hung Nguyen district of Synot Asean Joint Stock Company to promptly handle violations that occurred from the time the investor started construction of project items. However, because the inspection took place during the complicated development of the Covid-19 epidemic, the Provincial People's Committee requested the Hung Nguyen District People's Committee to stop the inspection according to Official Dispatch No. 7916/UBND-TD dated November 11./2020.

Implementing state management of construction order in the area, day 17/6/In 2021, Hung Nguyen District People's Committee together with Hung My Commune People's Committee inspected the project implementation of Synot Asean Joint Stock Company. At the time of inspection, the investor had built the following items: Main gate, guard house, office building (area 325m2), parking lot, water plant, water filtration tank, power station, generator house, garbage collection house, pump house, wastewater treatment tank, pond system, land leveling, construction of internal traffic system (total length 900m), drainage canal, tree planting and some works not included in the construction permit including: Old warehouse (75m2), fish feed processing plant (50m2), wooden stilt house(70m2), rest hut (9m2), fake mountain model foundation 1 in the Northwest of the project (690m), fake mountain model2 West - South of the project (300m)2), golf practice house foundation (300m2), 7 wonders of the world model foundation (454m2). Recorded administrative violations for construction of works without construction permits. Date25/In June 2021, the Chairman of Hung Nguyen District People's Committee issued Decision No. 583/QD-XPVPHC on administrative sanctions against Synot Asean Joint Stock Company for the act of "Organizing construction of a project without a construction permit when a construction permit is required by regulations" with a fine of VND 30,000,000.g(Thirty million dong).
August 14,2020, Synot Asean Joint Stock Company has prepared a dossier requesting adjustment of investment policy and sent it to the Provincial People's Committee and provincial departments, branches and sectors for consideration. After receiving opinions from the Departments: Natural Resources and Environment, Construction, Agriculture and Rural Development, Tourism, Provincial Tax Department and Hung Nguyen District People's Committee, the Department of Planning and Investment issued Document No.622/On February 25, 2022, SKHĐT-DN reported to the People's Committee of Nghe An province on adjusting the investment policy of the high-tech Israeli tilapia farming project in Hung My commune, agreeing to submit to the Provincial People's Committee for consideration and issuance of a Decision to adjust a number of contents in Decision No. 2333/QD-UBND dated June 1, 2017 of the Provincial People's Committee. However, after consideration, the Provincial People's Committee issued Document No. 1444/UBND-NN dated March 8, 2022 assigning the Department of Planning and Investment to preside over and coordinate with relevant agencies to review and clarify a number of contents of the project.
Implementing the direction of the Provincial People's Committee, on March 11, 2022, the Department of Planning and Investment issued Document No. 826/SKHDT-DN requesting the Departments of Construction, Natural Resources and Environment, Agriculture and Rural Development and the Tax Department to continue to coordinate to give opinions on the investor's adjustment contents. After receiving the response documents from the departments, branches and Explanation Document No. 145/GT-SYNOT dated May 25, 2022, the commitment document dated June 28, 2022 Synot Asean Joint Stock Company, on August 25, 2022, the Department of Planning and Investment presided over and coordinated with the Departments of Finance, Construction, Natural Resources and Environment, Agriculture and Rural Development, Nghe An Provincial Tax Department, Hung Nguyen District People's Committee, Hung My Commune People's Committee to inspect the site and make a record of the project inspection. On September 7, 2022, the Department of Planning and Investment issued Document No. 3533/SKHĐT requesting the Provincial People's Committee not to consider approving the adjustment of the project investment policy as proposed by Synot Asean Joint Stock Company. On September 12, 2022, the People's Committee of Nghe An province issued Document No. 6917/UBND-NN, stating that it has not considered approving the adjustment of the project investment policy for high-tech Israeli tilapia farming in Hung My commune.
During the process of implementing procedures to adjust the project investment policy, the investor still proceeded with construction of construction items without approval from the Provincial People's Committee, including:
Completed 3 project items including: Fake mountain model 1 in the Northwest of the project, construction area 690m22; model of 7 wonders of the world, construction area 454m2Golf practice house, construction area 300m2.
Constructing 7 new construction items including: 4 reinforced concrete pillars 1.5m high, construction area 25m2; reinforced concrete foundation, construction area 344.08m2; foundation, dashboard, internal steel erection, construction area 452.45m2; round house (according to the investor's report, it is a workers' canteen), construction area 530m22; 2-storey house behind the round house (according to the investor's report, it is a workers' rest house), construction area 102.24m2; temporary steel structure frame system, installation area 1,500m2; temporary chicken coop, construction area 485m2.

On compliance with the law in project implementation:
Regarding the legal documents before implementing the project, ensuring the provisions of law, the Company has been approved by the Provincial People's Committee for investment policy, the project has been approved for detailed planning at a scale of 1/500, the People's Committee of Nghe An province issued a decision on land lease, the Department of Natural Resources and Environment issued a certificate of land use rights, house ownership rights and other assets attached to the land, the Department of Construction issued a Construction Permit, the investor has fulfilled financial obligations as prescribed.
The investor has paid attention to the implementation of the project: The internal traffic system has reached 60%, the water supply system has reached 92%, the power supply system has reached 95%, the leveling and breeding ponds have reached 90%, the water plant, water filter tank, power station, generator house, garbage collection house, pump house, wastewater treatment tank have been invested in construction. The total area of breeding ponds, breeding ponds, settling ponds, and settling ponds is 34,900 m2.2(including outside the project scope 9,500 m)2) basically ensures the main goal and function of the project is to raise high-tech Israeli tilapia commercially. Through checking the actual construction status of project items, comparing with the approved planning, during the project implementation, Synot Asean Joint Stock Company had the following violations:
About construction order:
Construction partially inconsistent with the content of the granted construction permit includes 5 construction items: Leveling the ground, digging fish ponds, building a road system.gInternal traffic, canal system, office building construction.
Construction of 6 items without construction permit including: Fake mountain model 1 in the Northwest of the project, construction area 690m22(on commercial service land and internal traffic land); 2 fake mountain models on the West - South side of the project, construction area 300m22(on commercial service land and internal traffic land); Model7 World wonder, construction area 454m2(on commercial service land); Wooden stilt house, construction area70m2(on commercial service land and internal traffic land); Resting hut, construction area 9m2(on commercial service land); Golf practice house, construction area 300m2(on aquaculture land and internal traffic land).
These items were built by the investor before the time of preparing the application for adjustment of investment policy (month).8/2020), was administratively sanctioned by the District People's Committee, but the investor continued to complete the project without completing the adjustment of the construction permit.g.
Carrying out the construction of 2 new construction items on land belonging to the project that has been granted a land use right certificate that is not in accordance with the approved construction planning, including: Reinforced concrete underground foundation behind the office building, construction area 344.08m22(on commercial service land); 4 reinforced concrete pillars near the main gate, construction area 25m2(on commercial service land and internal traffic land).
Land violations:
The investor has implemented the project on an area of about 82,400m2, greater than 18,102m2compared to the area according to the granted land use right certificate. The additional area outside the project is rented or borrowed by the investor from households; Construction of 6 construction items outside or partly outside the project boundary granted land use right certificate, including: Round house, construction area 530m2(according to the investor's report, it is a workers' canteen); 2-storey house behind the round house, construction area 102.24m22(according to the investor's report, it is a workers' rest house); Old warehouse, construction area75m2; Fish feed processing house, construction area 50m2; Temporary steel structure frame system, construction area 1500m2; Temporary chicken coop, construction area 485m2; Building 1 foundation, building a dashboard inside, installing steel reinforcement behind the golf course, construction area 452.45m22on aquaculture land is not in accordance with the provisions of the Land Law.
People's Committee of Hung Nguyen districtSuggestion:
After checking and reviewing the violations, the District People's Committee directed the People's Committee of Hung My commune to organize the preparation of a record of administrative violations and submit it to the competent authority to issue a decision on administrative sanctions. Due to the nature of the project with commercial - service land and aquaculture land interspersed, the People's Committee of Hung Nguyen district respectfully submits to the Provincial People's Committee and relevant departments and branches for consideration and comments on the handling as follows:

For construction projects on commercial service land: According to the investor's report, the projects include: Fake mountain model 1 in the Northwest of the project, Fake mountain model2 Southwest of the project, Resting hut, Wooden stilt house, Model7 World wonders are warehouses, stylized factories and landscape works, although the construction is not in accordance with the approved planning, the construction density and height of the works do not exceed the general regulations of the law on construction planning. Therefore, the District People's Committee respectfully requests the Provincial People's Committee to assign relevant departments, branches and sectors to coordinate with the District People's Committee and the People's Committee of Hung My commune to inspect and re-evaluate the planning parameters, structure, functions..., whether they change the main objectives and functions of the project, which is high-tech commercial tilapia farming or not? If the construction items do not change the main objectives of the project, the construction planning will be adjusted, and the construction items that affect the main objectives of the project will be dismantled.
Regarding the lake system, internal traffic system, and canal system that were partially built in violation of the planning: Through actual inspection, the District People's Committee found that the technical infrastructure system still ensures to serve the main goals and functions of the project. The District People's Committee requested the Provincial People's Committee to assign relevant departments, branches, and sectors to coordinate with the District People's Committee and the People's Committee of Hung My commune to inspect and re-evaluate the planning parameters, structure, functions, etc. of these construction items to consider adjusting the planning.
For construction items on aquaculture land, the land is outside or partly outside the project boundary, including: Round house (according to the investor's report, it is a workers' canteen), 2-storey house behind the round house (according to the investor's report, it is a workers' rest house), old warehouse, fish feed processing house, temporarily erected steel frame system, temporary chicken coop, golf practice house, 1 foundation for building a dashboard inside and erecting steel reinforcement behind the golf practice house. These cases violate the Land Law, therefore, the District People's Committee requests the Provincial People's Committee to assign relevant departments and branches to coordinate with the District People's Committee and Hung My Commune People's Committee to organize the handling of violations according to the provisions of the Land Law.
