Director prosecuted for creating fraudulent projects and embezzling 130 billion VND to pay off debts.
On November 9th, the Economic Police Department of Bac Ninh Provincial Police, in coordination with the Provincial People's Procuracy, served the Decision to initiate criminal proceedings, the Decision to prosecute the defendants, and the Arrest Warrant for temporary detention against Phan Van Khien (born in 1989, residing at Dong Village, Chi Lang Commune, Bac Ninh) - Director, and Nguyen Thi Phuong (born in 1988, residing at Bo Son Commune, Vo Cuong District, Bac Ninh) - Accountant, of Hien Khiem Investment and Construction Co., Ltd. for the crime of "Fraudulent appropriation of property".
Following the directive of the Provincial Police Director regarding the fight against fraud and property appropriation, the Economic Police Department of the Provincial Police discovered that Hien Khiem Investment and Construction Co., Ltd. (address: 74 Le Hong Phong Street, Kinh Bac Ward, Bac Ninh Province) had no obligations or rights related to the Residential Area No. 1 Project in Hap Linh Ward, Bac Ninh Province during 2022, but had appropriated property from many victims.
Recognizing the complexity and seriousness of the case, the Economic Police Department deployed a comprehensive set of operational measures, focusing on investigation, evidence gathering, and combating the suspects.
During the initial investigation, the police determined that Hien Khiem Investment and Construction Co., Ltd. was not the investor of Residential Area No. 1 Project and had not been assigned any tasks related to the project by any state agency. However, from the beginning of March to the end of April 2022, Phan Van Khiem and Nguyen Thi Phuong provided information that Hien Khiem Company was carrying out land compensation and clearance, and would later seek approval to auction off service land to customers in the project. Through this, they signed contracts with 56 customers through 67 contracts, collecting nearly 130 billion VND (with a commitment to deliver the land within 36 months).
After receiving the money, the individuals did not carry out the project as promised, misappropriating the collected funds and using them for other purposes (primarily to pay off the company's old debts).
Following the delivery of the indictment decisions, the Economic Police Department conducted a search of Hien Khiem Investment and Construction Co., Ltd., seizing numerous seals, official stamps, and other documents related to Hien Khiem Company's operations.
Here, the company also changed its name to ANINVEST Vietnam Group Co., Ltd. and posted a notice of relocation to the commercial and service building of Ninh Giang Construction Group Joint Stock Company, located at 36 Ngo Tat To Street, Kinh Bac Ward, Bac Ninh Province, in order to continue defrauding other victims.
Furthermore, the investigating agency has clarified that Phan Van Khien and Nguyen Thi Phuong are currently engaging in the practice of soliciting capital contributions from customers for other projects, including a residential project in Yen Trung commune from 2017 to 2020, but to date, the land has not been allocated and the money has not been paid. There are signs of misappropriation of assets amounting to a large sum, causing public outrage.
Currently, the Investigation Police Department of Bac Ninh province has seized numerous seals, documents, papers, cars, etc., and is continuing to investigate and expand the case, consolidating evidence on other individuals involved in the fraudulent appropriation of property related to Hien Khiem Investment and Construction Co., Ltd.
The Investigation Police Department (Economic Police Division) of Bac Ninh Provincial Police announces and requests that any individuals or organizations involved in contributing capital to Hien Khiem Investment and Construction Co., Ltd. (now Aninvest Vietnam Investment and Construction Co., Ltd.) to carry out projects in the form of capital contribution contracts as mentioned above, come to the Investigation Agency to provide information for resolution according to the law.
