Former Minister Vu Huy Hoang receives a disciplinary warning.

Former Minister of Industry and Trade, Mr. Vu Huy Hoang, bears primary responsibility for the violations and shortcomings of the Party Committee of the Ministry of Industry and Trade during the 2011-2016 term.

From October 17th to 21st, 2016, the Central Inspection Committee held its seventh session in Hanoi. Comrade Tran Quoc Vuong, Member of the Political Bureau, Secretary of the Central Committee of the Party, and Chairman of the Central Inspection Committee, presided over the session.

At this meeting, the Central Inspection Committee (CIC) considered and concluded on the following matters:

I. Investigating and considering disciplinary action against the Party Committee of the Ministry of Industry and Trade for the 2011-2016 term and some individuals when signs of violations are detected.

1. The Party Committee of the Ministry of Industry and Trade for the 2011-2016 term committed the following violations and shortcomings:

- Failure to promptly revise, supplement, and implement the Working Regulations of the Party Committee as prescribed by the Politburo; violating the principle of democratic centralism in the organization and operation of the Party Committee.

- Lack of responsibility, lax leadership and guidance, violations of Party and State regulations on personnel work, specifically:

+ The recruitment, transfer, and appointment of Trinh Xuan Thanh and a number of other officials violated principles, procedures, standards, and conditions.

+ Violating Decision No. 83/2004/QD-BNV of the Ministry of Interior and Decision No. 81-QD/BCS of the Party Committee of the Ministry of Industry and Trade in appointing Trinh Xuan Thanh to the positions of Deputy Chief of Office, Head of the Ministry's Office in Da Nang, Chief of the Party Committee Office, Director, and Standing Member of the Enterprise Innovation and Development Board.

+ The evaluation and planning of personnel in some cases did not adhere to principles and procedures; allowing Comrade Vu Huy Hoang, Secretary of the Party Committee, to arbitrarily propose the approval of the supplementary planning for the position of Deputy Minister of Industry and Trade for Trinh Xuan Thanh and several other cases.

+ Violations of the Law on Prevention and Combat of Corruption and the Law on Enterprises in appointing Comrade Vu Quang Hai (son of Minister Vu Huy Hoang) as a supervisor of the Vietnam Tobacco Corporation; transferring and nominating him to participate in the Board of Directors and hold the position of Deputy General Director of Saigon Beer, Wine and Beverage Joint Stock Corporation (Sabeco).

- Lack of responsibility and violations of legal regulations on emulation and commendation in the assessment and recommendation for awarding the title of Hero of Labor to Vietnam Petroleum Construction Joint Stock Company (PVC).

2. Comrade Vu Huy Hoang, former member of the Central Committee of the Party, former Secretary of the Party Committee, former Minister of Industry and Trade.

Comrade Vu Huy Hoang bears primary responsibility for the violations and shortcomings of the Party Committee of the Ministry of Industry and Trade during the 2011-2016 term. Comrade Vu Huy Hoang personally committed the following violations and shortcomings:

- Lack of exemplary conduct and signs of self-serving behavior in the acceptance, appointment, and transfer of his son to the position of auditor at the Vietnam Tobacco Corporation; participation in the Board of Directors and holding the position of Deputy General Director of Sabeco, violating the Central Committee's regulations on what Party members are not allowed to do, the Secretariat's regulations on the responsibility of setting an example for cadres and Party members, violating the Law on Prevention and Combat of Corruption, causing public outrage.

- Failing to comply with Party and State regulations in approving the appointment of Trinh Xuan Thanh to the positions of Deputy Chief of Office, Head of the Ministry's Office in Da Nang; Chief of the Party Committee Office, Director, and Standing Member of the Enterprise Innovation and Development Board.

- Despite knowing that Trinh Xuan Thanh had committed violations and did not meet the qualifications, they still agreed to the Hau Giang Provincial Party Committee's proposal to transfer Trinh Xuan Thanh to work in Hau Giang province and appoint him as Vice Chairman of the Provincial People's Committee for the 2011-2016 term; they acted outside their authority when they requested the Hau Giang Provincial Party Committee to facilitate Trinh Xuan Thanh's participation in the Hau Giang Provincial Party Committee. They submitted dishonest reports about the activities of PVC and Trinh Xuan Thanh personally before the competent authority approved his appointment as Vice Chairman of the Hau Giang Provincial People's Committee.

- Directing the evaluation, planning, and proposing the approval of the deputy minister position for Trinh Xuan Thanh and several other individuals in violation of principles, procedures, and standards.

The aforementioned violations and shortcomings of the Party Committee of the Ministry of Industry and Trade and Comrade Vu Huy Hoang have caused serious consequences, affecting the prestige of the Party, the State, the Ministry of Industry and Trade, and Comrade Vu Huy Hoang personally, causing public outrage.

The Central Inspection Committee proposed that the Party Central Secretariat discipline the Party Committee of the Ministry of Industry and Trade for the 2011-2016 term with a reprimand; and issue a warning to Comrade Vu Huy Hoang, former Central Committee member, former Secretary of the Party Committee, and former Minister of Industry and Trade. The Committee requested that the Party Committee of the Ministry of Industry and Trade promptly direct the review and disciplinary action against organizations and individuals who violated regulations; and revoke and annul erroneous decisions in personnel matters within the Ministry of Industry and Trade.

3. Comrade Dao Van Hai, former member of the Party Committee, former Director of the Personnel and Organization Department, and Comrade Ho Thi Kim Thoa, member of the Party Committee, Deputy Minister of Industry and Trade, have committed the following violations and shortcomings:

- Comrade Dao Van Hai bears joint responsibility for the violations and shortcomings of the Party Committee of the Ministry of Industry and Trade during the 2011-2016 term. Comrade Dao Van Hai personally committed violations and shortcomings in advising and proposing to the Party Committee and the leadership of the Ministry of Industry and Trade the recruitment, appointment, planning, evaluation, and transfer of many cadres in violation of Party and State regulations, causing serious consequences.

- Comrade Ho Thi Kim Thoa bears some responsibility for the violations and shortcomings of the Party Committee of the Ministry of Industry and Trade during the 2011-2016 term. Comrade Ho Thi Kim Thoa personally committed violations and shortcomings in agreeing to the proposal to accept and appoint Trinh Xuan Thanh contrary to regulations; and failing to adhere to principles and regulations when signing decisions to appoint and transfer several officials.

Based on Regulation No. 181-QD/TW of the Politburo on disciplinary action against violating Party members, the Central Inspection Committee decided to impose a reprimand on Comrade Ho Thi Kim Thoa; and a warning on Comrade Dao Van Hai.

II- Regarding the resolution of the complaint against Comrade Le Dan, former Secretary of the Party Committee for Overseas Affairs

After reviewing and resolving the complaint against Comrade Le Dan, the Central Inspection Committee concluded: Over the past period, the Standing Committee of the Party Committee for Overseas Affairs has allowed prolonged disunity to occur; violated the principles of democratic centralism and self-criticism; had many errors and shortcomings in personnel work; and failed to seriously implement the Central Inspection Committee's Notice of Conclusion No. 896-TB/UBKTTW, dated September 24, 2015.

As the head, Comrade Le Dan bears primary responsibility for the violations and shortcomings of the Standing Committee of the Party Committee for Overseas Affairs during the 2010-2015 term. Comrade Le Dan himself lacked awareness of maintaining internal unity; showed a lack of respect for the collective; his working methods and style were limited; he did not seriously address and correct the shortcomings identified after the inspection, and continued to commit new shortcomings and violations in personnel work.

The violations and shortcomings of the Standing Committee of the Party Committee for Overseas Affairs and Comrade Le Dan warrant disciplinary action. The Central Inspection Committee has decided to initiate the process of reviewing and handling disciplinary action against Comrade Le Dan and the Standing Committee of the Party Committee for Overseas Affairs for the 2010-2015 term.

III- Specialized inspection on the prevention, detection, and handling of corruption in the tax and customs sectors.

Following the direction of the Central Steering Committee on Anti-Corruption, the Central Inspection Committee conducted a thematic inspection on the prevention, detection, and handling of corruption in the tax and customs sectors.

The inspection revealed that, in addition to the achievements, the fight against corruption in the tax and customs sectors still has some limitations and shortcomings that need to be addressed promptly. The Central Inspection Committee reports this to the Central Steering Committee on Anti-Corruption for consideration and guidance.

IV- Review and resolve certain cases within the scope of authority.

1. Regarding the handling of complaints related to Party discipline.

- The Central Inspection Commission has provided input to the Party Disciplinary Appeals Committee's delegations regarding three cases.

- Decisions were made to resolve disciplinary complaints within the scope of authority in two cases.

2. Regarding the inspection of the implementation of tasks related to inspection, supervision, enforcement of Party discipline, and inspection of Party finances.

Through inspections of the performance of inspection, supervision, and disciplinary tasks within the Party for the Standing Committees of the Provincial Party Committees and the Provincial Inspection Committees of the provinces of Hai Duong, Vinh Phuc, Lang Son, Phu Tho, Thua Thien Hue, Phu Yen, Dong Nai, and Tra Vinh; and inspections of Party finances for the Editorial Board of the Communist Magazine and the Editorial Board of the Nhan Dan Newspaper, the Central Inspection Committee has pointed out the strengths, weaknesses, and shortcomings of the localities and units, and requested lessons learned and corrective measures for the future.
