What are the bases for district-level land use planning? Mr. Vu Tuan Dat (Yen Thanh, Nghe An) is concerned about.

Reply:Pursuant to Clause 1, Article 66 of the 2024 Land Law, the basis for establishing district-level land use planning includes:

- Provincial planning, provincial land use planning; urban planning of centrally-run cities in cases where provincial land use planning is not established;

- Technical and specialized plans;

- District-level socio-economic development plan;

- Natural, economic and social conditions of district-level administrative units;

- Current status of land use, land fluctuations, land potential and results of implementing previous land use planning at district level;

- Demand and land use capacity of sectors, fields, and People's Committees at the commune level; for determining the demand for residential land, urban land, and rural residential land, it is determined based on population forecasts, infrastructure conditions, landscape, and environment according to regulations of the law on construction;

- Land use norms, scientific and technological advances related to land use.

- Within no more than 05 working days from the date of receiving the complete dossier for comments, the provincial land management agency must send the land use planning dossier to the members of the Appraisal Council for comments.

- Members of the Appraisal Council must send written comments to the provincial land management agency within no more than 15 days from the date of receiving the request for comments.

- Within no more than 10 days from the end of the time for collecting opinions, the provincial land management agency shall be responsible for organizing a meeting of the Appraisal Council and sending a notice of the results of the appraisal of the land use planning to the People's Committee at the district level.

- The District People's Committee must receive and explain the opinions of the Appraisal Council and complete the land use planning dossier to send back to the provincial land management agency within no more than 10 days.

- The provincial land management agency will submit to the provincial People's Committee for approval of the district-level land use plan within no more than 10 days from the date of receiving complete and valid documents.
