What are the necessary bases for developing district-level land use plans? This is a question of concern to Mr. Vu Tuan Dat (Yen Thanh, Nghe An).
Reply:According to Clause 1, Article 66 of the 2024 Land Law, the basis for establishing district-level land use planning includes:
- Provincial planning, provincial-level land use planning; urban planning of centrally-governed cities in cases where provincial-level land use planning is not prepared;
- These plans are technical and specialized in nature;
- District-level socio-economic development plan;
- Natural, economic, and social conditions of the district-level administrative unit;
- Current land use status, land changes, land potential, and results of previous land use planning implementation at the district level;
- The needs and land use capacity of various sectors and fields, and the People's Committees at the commune level; the determination of land use needs for residential land, urban land, and rural residential land is based on population forecasts, infrastructure conditions, landscape, and environment as prescribed by the law on construction;
- Land use standards, and scientific and technological advancements related to land use.
- Within no more than 05 working days from the date of receiving all the necessary documents for consultation, the provincial land management agency must send the land use planning documents to the members of the Appraisal Council for their opinions.
- Members of the appraisal council must submit their written opinions to the provincial land management agency within no more than 15 days from the date of receiving the opinion request.
- Within no more than 10 days from the end of the consultation period, the provincial land management agency is responsible for organizing a meeting of the Appraisal Council and sending a notification of the appraisal results of the land use plan to the district People's Committee.
- The district-level People's Committee needs to consider and explain the opinions of the Appraisal Council and finalize the land use planning dossier to resubmit it to the provincial-level land management agency within no more than 10 days.
- The provincial land management agency will submit the district-level land use plan to the provincial People's Committee for approval within no more than 10 days from the date of receiving a complete and valid dossier.
