What are the regulations regarding land leasing under the 2024 Land Law?
Mr. NXD from Dien Chau asks: According to the 2024 Land Law, how is the leasing of land specifically regulated?
Article 120 of the 2024 Land Law stipulates the following regarding land leasing:
1. The State leases land and collects rent in a lump sum for the entire lease period or collects rent annually in cases not covered by Articles 118 and 119 of this Law.

2. The State leases land and collects the land rent in a lump sum for the entire lease period in the following cases:
a) Using land to implement investment projects in agriculture, forestry, aquaculture, and salt production;
b) Use of land in industrial zones, industrial clusters, high-tech zones, and worker accommodation within industrial zones; land used for public purposes with commercial objectives; use of commercial and service land for tourism activities and office businesses;
c) Using land to build social housing for rent in accordance with the law on housing.
3. The State leases land and collects annual land rent in the following cases:
a) Cases not covered by Clause 2 of this Article;
b) Cases specified in Clause 2 of this Article where there is a need to pay annual land rent;
c) Public non-business units shall choose the form of land lease in accordance with the provisions of Clause 3, Article 30 of this Law.
4. The land leasing stipulated in this Article shall be carried out in accordance with the provisions of Articles 124, 125 and 126 of this Law.
