How does the 2024 Land Law regulate land leasing?

Article 120 of the 2024 Land Law stipulates land lease as follows:

1. The State shall lease land and collect land rent at one time for the entire lease term or collect land rent annually in cases not specified in Articles 118 and 119 of this Law.

2. The State leases land and collects land rent at once for the entire lease term in the following cases:

a) Use land to implement investment projects in agricultural, forestry, aquaculture and salt production;

b) Use of land in industrial parks, industrial clusters, high-tech zones, worker accommodation in industrial parks; land used for public purposes with business purposes; use of commercial and service land for tourism activities and office business;

c) Use land to build social housing for rent according to the provisions of the law on housing.

3. The State leases land and collects annual land rent in the following cases:

a) Cases not covered by the provisions of Clause 2 of this Article;

b) Cases specified in Clause 2 of this Article where there is a need to pay annual land rent;

c) Public service units choose the form of land lease according to the provisions of Clause 3, Article 30 of this Law.

4. Land leases prescribed in this Article shall be carried out in accordance with the provisions of Articles 124, 125 and 126 of this Law.
