Fines for setting up tents on sidewalks and roads.

Ms. TTH (Thanh Vinh ward) asks: I've noticed that many families, when having events like weddings or funerals, often utilize the sidewalks, even setting up tents on the road, obstructing traffic. Is this a violation of the law? If so, what are the penalties?

Reply:
According to Article 77 of the 2024 Law on Road Traffic Order and Safety, the road surface is only for traffic purposes, while the sidewalk is for pedestrians. Therefore, in cases where it is necessary to temporarily use the road surface or sidewalk for weddings, funerals, or to set up parking areas for family events, residents must notify the People's Committee of the ward or commune where they reside for consideration and permission to temporarily use a portion of the sidewalk.

If sidewalks or roadways are occupied without permission, or if tents are erected or events are organized without notification, permission, or in violation of the permitted content, this act will be handled according to Decree 168/2024/ND-CP on administrative penalties for violations in the field of road traffic order and safety, effective from January 1, 2025. Clause 12, Article 12 of the decree stipulates a fine of 10 to 15 million VND for individuals and 20 to 30 million VND for organizations when using roadways or sidewalks for purposes other than those requiring a permit but without a permit, with an expired permit, or using them in a manner inconsistent with the content stated in the permit.

Therefore, erecting tents and occupying roads and sidewalks to hold weddings or funerals without approval from the competent authorities is a violation of the law and can result in substantial fines.
