Penalty for using umbrellas while participating in traffic

When participating in traffic, drivers and passengers of vehicles using umbrellas may be subject to administrative penalties because this behavior limits visibility and causes traffic insecurity. According to Decree 100/2019/ND-CP, the related penalties are prescribed as follows:

For drivers of motorbikes, mopeds (including electric motorbikes), motorbike-like vehicles and moped-like vehicles using umbrellas when participating in traffic:

- A fine of 100,000 VND to 200,000 VND shall be imposed on drivers carrying passengers using umbrellas; (Point g, Clause 1, Article 6Decree 100/2019/ND-CP)

- A fine of VND 800,000 to VND 1,000,000 shall be imposed on drivers using umbrellas, mobile phones, audio devices, except hearing aids; (Point h, Clause 4, Article 6Decree 100/2019/ND-CP, modified atDecree 123/2021/ND-CP)

In addition to fines, drivers who use umbrellas while participating in traffic will also be subject to the following additional penalties:

- Driver's license is revoked for 01 to 03 months. (Point b, Clause 10, Article 6)Decree 100/2019/ND-CP)

- In case of using an umbrella while participating in traffic and causing a traffic accident, the driver's license will be revoked for 02 to 04 months. (Point c, Clause 10, Article 6)Decree 100/2019/ND-CP)

For drivers of bicycles, motorbikes (including electric bicycles), and other primitive vehicles using umbrellas when participating in traffic:

Fines from VND 80,000 to VND 100,000 for drivers using umbrellas or mobile phones; carrying passengers on bicycles or motorbikes using umbrellas; (Point h, Clause 1, Article 8Decree 100/2019/ND-CP)

For passengers who use umbrellas while participating in traffic

- Fine from 80,000 VND to 100,000 VND for people being carried on bicycles or motorbikes using umbrellas. (Clause 1, Article 11Decree 100/2019/ND-CP)

- A fine of 100,000 VND to 200,000 VND shall be imposed on people being transported on motorbikes, mopeds (including electric motorbikes), motorbike-like vehicles and motorbike-like vehicles using umbrellas; (Point c, Clause 2, Article 11Decree 100/2019/ND-CP).
