New rates for land use fees and water surface lease fees in the Economic Zone.

Decree 35/2017/ND-CP, regulating the collection of land use fees, land lease fees, and water surface lease fees in economic zones and high-tech zones, has just been issued by the Government.

Specifically, the determination of land use fees for cases where the State allocates land with land use fees, changes land use purposes, or transfers land use rights within the Economic Zone to implement investment projects for the construction of commercial housing for sale or for sale combined with leasing according to the plan; and where the State allocates residential land, recognizes residential land use rights, or permits the conversion of land use purposes to residential land for households and individuals within the Economic Zone, shall be carried out in accordance with the provisions of Government Decree 45/2014/ND-CP dated May 15, 2014, on land use fee collection and any amending or supplementary documents (if any).

Determining land lease fees in the Economic Zone

The Decree specifies the method for determining land rent in the Economic Zone. Accordingly, in cases where the State leases land on an annual basis without auctioning as prescribed by law, the annual land rent unit price is determined by multiplying a percentage (%) by the specific land price used for calculating land rent.

In this context, the percentage used to calculate the land lease price ranges from 0.5% to 3%. The People's Committees of provinces and centrally-governed cities shall specify the details for each land location, area, and road corresponding to each land use purpose according to the planning approved by competent state agencies and publicly announced during the implementation process.

The land lease rate for cases where land is leased on an annual basis without auction is fixed for 5 years from the date the Economic Zone Management Board decides to lease the land or the Provincial People's Committee decides to lease the land. After the stabilization period, the Economic Zone Management Board will adjust the land lease rate applicable for the subsequent period according to the policies and land prices at the time of adjustment.

In cases where the State leases land with a one-time payment for the entire lease period without auctioning as prescribed by law, the one-time land lease price for the entire lease period is the specific land price corresponding to the lease term.

The decree also specifies cases where the State leases land through auction in accordance with the law; and determines the land lease fee in cases where the State leases land with water surface within the Economic Zone.

Lease price framework for water surface areas in the Economic Zone

The price range for leasing water surface areas within the Economic Zone, for water surfaces not covered by Article 10 of the Land Law, is stipulated as follows: From 20-300 million VND/km2/year for projects using fixed water surface areas; from 100-750 million VND/km2/year for projects using non-fixed water surface areas.

Based on the above-mentioned water surface lease price framework, the provincial People's Committee decides the water surface lease price for each project as a basis for the Economic Zone Management Board to notify the amount of water surface lease fees to be paid.

The decree takes effect from June 20, 2017.
