In 2025, what types of land will be used for mixed-use purposes?
As far as I know, the 2024 Land Law allows for the combined use of land for multiple purposes. Therefore, I would like to ask, which types of land are eligible for multi-purpose use? This is a question from Mr. Hoang Anh Tu (Nghia Mai commune, Nghe An province).
Reply:According to Clause 1, Article 218 of the 2024 Land Law, the types of land that can be used for multiple purposes include the following:
- Agricultural land is used in combination with commercial, service, livestock farming, and medicinal plant cultivation purposes;
- Land used for public purposes is combined with commercial and service purposes;
- Land designated for public service facilities may be used in combination with commercial and service purposes;
- Residential land is used in combination with agricultural, commercial, service, and business-oriented public works;
- Land with water surface is used for multiple purposes as stipulated in Articles 188, 189 and 215 of the 2024 Land Law;
- Religious land and land dedicated to beliefs may be used in combination with commercial and service purposes;
- Land as stipulated in Clauses 2 and 3, Article 9 of the 2024 Land Law is used for a combination of agricultural purposes and the construction of postal, telecommunications, technology, information, outdoor advertising, and solar power infrastructure; specifically, land within the agricultural land group and the non-agricultural land group.
In addition, the combined multi-purpose use must meet the requirements specified in Clause 2, Article 218 of the 2024 Land Law, such as:
- It does not change the land type according to the land classification.
- Without compromising the necessary conditions for returning the land to its primary use;
- It does not affect national defense or security;
- Minimize impacts on the conservation of natural ecosystems, biodiversity, and environmental landscapes;
- It does not affect the land use of adjacent plots;
- Fulfill all financial obligations as required by law;
- Comply with relevant laws.
