The case file shows that on the evening of April 20, 2024, Lo Van Duong's family organized a dinner and drinking party. Because Duong was HIV positive and lived a dirty life, the family did not allow him to eat with them. They did provide food for Duong to eat and drink with a friend.
After eating, Duong walked to Mrs. Lo Thi H.'s house. When Mrs. H. opened the door, Duong said: "Please give me 10 thousand to buy some wine." At that moment, Mrs. H. pushed Duong away and said: "Go home, I'll give it to you tomorrow, it's late now."
Immediately after that, Duong took the iron bar he was carrying and hit Mrs. H. many times in the face and body. After receiving many consecutive hits from the young man, Mrs. H. fell to the ground unconscious.
After committing the crime, Duong went home and went to sleep as if nothing had happened. The next morning, Ms. H.'s son came home and discovered that his mother had died from a fractured skull. Immediately after, Duong was arrested by the police and investigated for murder.
During the detention, the investigation agency found that Lo Van Duong showed signs of mental abnormalities, so they requested a psychiatric assessment. The conclusion was that Duong had a mental disorder due to excessive drug use.
At the trial, the defendant admitted to the murder. Regarding the cause of the crime, the defendant stated that he asked the victim for money but was not given it, which led to anger.
The defendant's father came to court to present his family's difficult circumstances and that the defendant had been ill for many years, asking the court to reduce his son's sentence.
The panel of judges determined that the defendant’s actions were dangerous to society and constituted murder. In this case, the defendant had the aggravating circumstance of committing the crime against a person 70 years of age or older. However, the defendant’s honest confession and remorse… are mitigating circumstances that need to be considered.
Considering the case as a whole, the panel sentenced Lo Van Duong to 20 years in prison for murder. In terms of civil matters, the court ordered the defendant to compensate the victim’s family more than 250 million VND.
