Nghe An proposes a special mechanism for land leveling for 10 key projects.
In order to accelerate the progress of key investment projects in the province, Nghe An is considering and applying special mechanisms in the exploitation of land for leveling purposes.
Specifically, 10 key projects are proposed to allow the exploitation of earth fill materials under the mechanism stipulated in Resolution 66.4/2025/NQ-CP dated September 21, 2025, of the Government on special mechanisms to remove obstacles in the application of the 2024 Law on Geology and Minerals, including:
- VSIP Nghe An 2 Industrial Park in Tan Chau commune;
- VSIP Nghe An 3 Industrial Park in Hung Nguyen commune;
- WHA Zone 1 Industrial Park - Nghe An, located in Trung Loc commune.
- WHA Zone 2 Industrial Park - Nghe An Province, located in Phuc Loc and Than Linh communes;
- Hoang Mai Industrial Park I is located in Hoang Mai ward.
- Hoang Mai II Industrial Park is located in Hoang Mai ward and Quynh Thang commune.
- The North-South high-speed railway project.
- The Vinh - Thanh Thuy expressway project.
- The project to upgrade and expand Vinh International Airport.
- The project for a special national historical site in Kim Lien.
According to surveys and proposals from relevant units, the total volume of earth and rock for leveling the ground for these projects is over 10 million cubic meters.3earth and rock. According to the 2024 Law on Geology and Minerals, opening mines for Group III and IV fill material requires more than 18 to 24 months, in addition to administrative procedures, auction procedures, and granting mining rights to businesses. Therefore, to ensure a timely supply of fill material for key projects like the ones mentioned above, the procedures need to be streamlined.
Mr. Nguyen Cong Luc, Head of the Mineral Resources Department of the Nghe An Department of Agriculture and Environment, shared: Applying Resolution 66.4/2025/NQ-CP on special mechanisms for land acquisition and leveling creates favorable conditions for investors, ensuring project progress through a streamlined process, reducing some administrative procedures and waiting times.
However, the application of this special mechanism must also ensure full compliance with procedures for mining and safety of geological and mineral resources; the transportation of earth and rock must be monitored and meet environmental protection criteria.
Resolution 66.4/2025/NQ-CP dated September 21, 2025, of the Government on special mechanisms and removal of obstacles in the application of the 2024 Law on Geology and Minerals allows:
- The relevant units are not required to carry out procedures for deciding or approving investment policies or approving investment projects;
- It is not necessary to base the decision on land use planning or annual land use plans, and it is not necessary to carry out procedures for changing the land use purpose, except for land used for national defense and security purposes;
- No procedures for reviewing and approving environmental impact assessment reports, issuing environmental permits, or registering environmental information are required.
- It is not based on the geological and mineral resource management plan stipulated in Clause 2, Article 12 of the Law on Geology and Mineral Resources;
In addition, it is permitted to extend (if there are still reserves as per the license) and adjust mining licenses to increase the mining capacity of Group III minerals used as construction materials and Group IV minerals for existing mines with valid mining licenses to serve the works, projects, and tasks specified in Clause 1 of this Article, and this shall be implemented as follows:
+ Licenses may be adjusted to increase mining capacity (without increasing the licensed reserves) according to the needs of construction projects, but not exceeding 50% for riverbed and estuarine sand and gravel, and without restrictions for other Group III minerals and Group IV minerals...
