Nghe An province prosecutes 4 commune officials for fabricating documents related to the construction of a village cultural center.
(Baonghean.vn) - Four officials have been prosecuted, including the commune chairman and civil servants in land administration, construction, agriculture, environment, and justice, who also serve as the treasurer of Hop Thanh commune People's Committee, Yen Thanh district.
On August 17, 2021, the Investigation Police Department of Nghe An Province announced that it had coordinated with the People's Procuracy of Nghe An Province to serve decisions and execute arrest and search warrants against four defendants to facilitate the investigation into the crime of "Abuse of position"authority while performing official duties" as stipulated in Clause 2, Article 356 of the Penal Code.

Previously, on August 13, 2021, the Investigation Police Department of Nghe An province issued a decision to initiate a criminal case and prosecute four defendants in Hop Thanh commune, Yen Thanh district, for the crime of "Abusing position and power while performing official duties" as stipulated in Clause 2, Article 356 of the Penal Code.
The defendants include:Nguyen Mao (born 1963), former Chairman of Hop Thanh Commune People's Committee, residing in Ly Nhan hamlet; Truong Van Chung (born 1973), residing in Dong Tien hamlet, Chief Accountant of the Commune People's Committee; Nguyen Cong Bang (born 1986), residing in Ly Nhan hamlet, is a civil servant in land administration, construction, agriculture, and environment of the Commune People's Committee; Nguyen Thi Thuong (born 1977), residing in Phan Xa hamlet, is a civil servant in Justice and Treasurer of the Commune People's Committee.
Simultaneously, the Police Investigation Agency issued search warrants for the residences and workplaces of the defendants; ordered the arrest and detention of defendants Nguyen Mao and Truong Van Chung for a period of 4 months; and issued orders prohibiting defendants Nguyen Thi Thuong and Nguyen Cong Bang from leaving their place of residence.

Accordingly, on June 16, 2021, the Investigation Police Agency (Economic Police) of Nghe An Provincial Police received and processed a criminal complaint from a citizen of Hop Thanh commune, alleging violations by several officials of the Hop Thanh Commune People's Committee, Yen Thanh district, Nghe An province, in financial management, causing damage to the State budget.
An investigation into the citizen's complaint was conducted, determining that: During the period from 2016 to 2018, Mr. Nguyen Mao (born in 1963), then Chairman of the People's Committee of Hop Thanh commune, Yen Thanh district, directed subordinates to illegally disburse budget funds, amounting to hundreds of millions of VND each year.

To legitimize these illegal expenditures and conceal the wrongdoing, at the end of 2018, Mr. Nguyen Mao instructed his subordinates, including Mr. Truong Van Chung, Mr. Nguyen Cong Bang, and Ms. Nguyen Thi Thuong, to falsify documents regarding the disbursement of funds for the construction of the cultural center in Chua Hamlet, Hop Thanh Commune, causing a loss of 300 million VND to the state budget. In reality, the cultural center in Chua Hamlet, Hop Thanh Commune, had already been built with support from the Commune People's Committee in 2017, amounting to 350 million VND.
After the investigation and collection of documents and evidence, the Police Investigation Agency found sufficient grounds to determine the criminal acts of the suspects, so they proceeded with the necessary steps.litigationas mentioned above.
The investigating agency is currently actively expanding the investigation and gathering evidence to handle the case according to the law.
