Nghe An: A commune land management official was dismissed from his job for 'abusing his position and authority to misappropriate property'.

February 16, 2023,Con Cuong District People's CommitteeThe authorities issued a disciplinary decision against Ms. Luong Thi Nam, a civil servant in the land administration, agriculture, construction, and environment department of Thach Ngan commune. The disciplinary action Ms. Luong Thi Nam received was dismissal from her job.

The reason Ms. Luong Thi Nam was dismissed from her job was because she had previously been sentenced by the People's Court of Con Cuong District to one year of suspended imprisonment with a two-year probation period for the crime of "Abusing her position and authority to appropriate property".

Clause 2, Article 30 of Government Decree No. 112/2020/ND-CP dated September 18, 2020, on disciplinary action against officials, civil servants, and public employees; and Clause 3, Article 79 of the 2008 Law on Officials and Civil Servants, as amended and supplemented in 2019, stipulate that in cases where a civil servant commits a violation and is convicted by a court of corruption, the competent authority shall issue a disciplinary decision to dismiss the employee. The dismissal period is 15 days from the date of receipt of the legally effective decision or judgment of the court.

Furthermore, Clause 1, Article 2 of the Law on Prevention and Combat of Corruption No. 36/2018/QH14 dated November 20, 2018, clearly stipulates acts of corruption in the State sector committed by persons holding positions and authority in agencies, organizations, and units in the State sector, including the act of "Abusing position and authority to appropriate property".

In Con Cuong district, the Party committee and government regularly strengthen the implementation of administrative discipline and order in agencies and units. Specifically for the land administration officials at the commune and district levels, the district has issued documents and directives, and established inspection teams to rectify responsibilities, improve public service ethics, and strictly prohibit bribery and accepting gifts in violation of regulations; it has been emphasized that anyone who violates these rules will be severely punished.

Regarding the case of Ms. Luong Thi Nam, the representative of the Con Cuong District People's Committee stated: "Previously, Ms. Nam had violated regulations in state land management and was disciplined with a reprimand. However, she continued to violate the regulations and was sentenced by the court to a suspended prison term for 'abusing her position and authority to appropriate property,' which the court determined to be an act of corruption. Therefore, based on the provisions of the law, Con Cuong district decided to discipline Ms. Luong Thi Nam by dismissing her from her job."
