(Baonghean.vn) - Recently, through a comprehensive inspection of 72 apartment buildings, the Provincial People's Committee concluded that 64 apartment buildings were built in violation of approved designs and 8 apartment buildings were built beyond the approved floor levels.

Comprehensive inspection, 72/72 apartment buildings violated
Implementing the Notice of conclusion of the questioning session (December 2016) and the Resolution on the results of supervision of the Provincial People's Council (2017) related to planning, construction licensing and management of high-rise apartments in the province; recently, the Provincial People's Committee has directed departments, branches and localities to advise on documents and strengthen the management of planning, construction licensing and management of high-rise apartments in the province.
In particular, the Provincial People's Committee has also directed and urged departments, branches and localities to handle existing problems and limitations in investment, construction and management of apartment buildings. Of which, 4 projects have been adjusted from high-rise apartment buildings to low-rise buildings in areas that do not meet the technical infrastructure requirements; at the same time, a number of projects have been reviewed and planned.

Regarding the issuance of housing use right certificates (LURCs), out of a total of 5,586 apartments assessed for transfer conditions in 32 projects, 4,059 apartments have been granted LURCs, reaching 72.7%.
The Provincial People's Committee has also established an interdisciplinary inspection team to comprehensively inspect 72 apartment buildings that have been built and put into use in the province; clearly indicating violations, responsibilities, measures and time to handle violations for each project.
The inspection results of 72 apartment buildings showed that all 72 apartment buildings had violations; of which 64 apartment buildings were not constructed in accordance with the design documents that had been appraised and approved by competent authorities or were not in accordance with construction standards and regulations. In particular, 8 apartment buildings were constructed with more floors than the approved planning.
Clarify responsibilities and measures
Besides the active participation of the Provincial People's Committee, sectors and localities; at the explanation session, the issue that the meeting participants were interested in was the responsibility as well as handling measures for cases of violations of approved designs, especially 8 apartment buildings with extra floors.
According to Mr. Nguyen Truong Giang - Acting Director of the Department of Construction, the Department is currently conducting a re-inspection. If any construction is not safe, it will be dismantled; if it is safe and in accordance with the planning, the investor will be required to prepare a dossier and submit it to the competent authority for approval of adjustment of the detailed construction planning, approval of adjustment of the construction design and apply measures to force the return of illegal money according to regulations, equal to 50% of the total construction value of the number of excess floors.

Some members attending the meeting also pointed out many existing problems and limitations, requesting the Provincial People's Committee and the Department of Construction to clarify responsibilities and handling measures in the coming time, because there have been problems and violations that have occurred for many years.
It is noteworthy that there are 13 apartment buildings that have not been accepted by competent authorities but have been put into use and people have moved in.
On the other hand, there are currently 6 apartment buildings with roads and water sources that are not guaranteed to allow fire trucks to access easily; this is an extremely dangerous problem in case of fire or explosion.

Although the granting of housing use right certificates has been given attention, the granting rate is still low. There are still 32 apartment buildings that have not established a management board; the management of the apartment building maintenance fund is not in accordance with regulations...
Based on the issues raised at the explanation session, the Standing Committee of the Provincial People's Council requested the Provincial People's Committee and related departments, branches and localities to continue to effectively implement Directive No. 29/CT-TTg dated October 9, 2018 on strengthening the effectiveness of State management over the management, operation and use of apartment buildings; Conclusion of the inspection results of the Provincial People's Committee on compliance with the law on investment, land management and use of apartment buildings in the province.

Along with that, it is necessary to closely consider the approval of investment policies for the construction of high-rise apartments in urban centers and densely populated areas; strengthen direction and inspection of management and acceptance of construction quality at apartment buildings under construction; strengthen propaganda and dissemination of laws on the operation and use of apartment buildings...
On the same day, the Standing Committee of the Provincial People's Council also explained the institutional reform work in administrative reform in the province.
