Many violations at apartment buildings in Vinh City make people angry

The recent protests and demands for rights by residents of Bong Sen apartment building in Quang Trung ward (Vinh city) are not new. Because in Vinh city, there are still many apartment buildings with violations that affect the rights of the people.

Multiple violations

Bong Sen Apartment was built in 2011, invested by Nghe An Tourism Joint Stock Company, is 22 stories high and has 140 households living in it. Although the houses were handed over to residents in 2013, the investor has not yet established a Management Board, leading to many management and maintenance issues not being properly handled.

A resident of this apartment building was upset that the lack of an official Management Board meant that the 2% maintenance fee had not been clearly handled. Not to mention, after many years of use, some items in the apartment building have seriously degraded and have not been repaired in a timely manner. The elevator is often damaged; the drainage system is degraded... greatly affecting the lives of residents.

Residents also complained that the investor has not yet arranged a community center in accordance with legal regulations, causing inconvenience in residents' collective activities.

Bao Son apartment building located on Le Loi street (Hung Binh ward) is also a painful case, causing public indignation. Since 2016, Bao Son Investment and Tourism Group Joint Stock Company (investor) has been constructing this apartment building under the name "High-class commercial service building - housing". In which, the apartment building is built with a height of 31 floors above ground, construction area of ​​1,940.0m2; low-rise houses (townhouses) 4 floors high and 1 attic, total 13 lots, construction land area 1,101.1m2.

It is worth mentioning that after the construction was completed, more than 500 apartments were handed over and residents moved in. However, after that, the authorities inspected and discovered that the legal documents of the project did not have an investment policy decision from the Provincial People's Committee. And the fact that the investor and relevant agencies carried out investment preparation steps and implemented the project without an investment policy decision was against the law.

This has made it impossible for the building to obtain a decision approving the results of the acceptance test to put the project into use from the competent authority - directly the Ministry of Construction, so it cannot carry out the next steps to issue red books to the people.

Similarly, the Vinaconex 9-CT B apartment building is located right at the intersection of Xo Viet Nghe Tinh Avenue and 72m Street, in Hamlet 19, Nghi Phu Commune (Vinh City). This project is invested by Construction Joint Stock Company No. 9, headquartered in Hanoi. Although they bought the house and moved in more than 10 years ago, up to now, about 70 households here have not been granted a Certificate of land use rights, house ownership rights and other assets attached to the land... In addition, residents here are also upset with the situation of the apartment building's damaged and leaking roof; the elevator has been damaged for a long time; the maintenance cost has not been clarified, so for a long time, the damage to the apartment building, people have had to contribute money to repair it...

The province currently has about 110 real estate projects with apartment buildings and more than 140 buildings. Of these, more than 95 buildings have been built and put into use, with nearly 15,000 apartments, meeting the housing needs of the people.

However, in reality, there are still many shortcomings related to apartment projects, which have led to disputes and complaints, affecting people's lives. In particular, the progress and quality of technical infrastructure, social infrastructure, maintenance, public sanitation, and fire protection systems in many apartment buildings have degraded and do not meet regulations. The lack of parking spaces in apartment buildings, forcing people to encroach on the streets and sidewalks for parking, has also become a pressing issue, causing urban disorder, environmental sanitation, and affecting the city's urban beauty...

Strengthening management

On November 5, 2021, Vinh City People's Committee issued Decision No. 5694/QD-UBND approving the Project "Administrative management of apartment buildings and new urban areas in Vinh City for the period 2021-2025".

This project aims to improve the quality of management and operation of apartment buildings and new urban areas in the city. Review the implementation of construction permits for apartment projects related to the issuance of certificates of land use rights, house ownership rights and other assets attached to land that affect the legitimate rights and interests of the people. At the same time, contribute to the final resolution of disputes and complaints in the recent past.

However, in the face of prolonged shortcomings, it is very difficult to completely resolve pressing issues that directly affect people's rights.

Recently, on October 1, 2024, the Provincial People's Committee issued Document No. 8532/UBND-CN on the implementation of the Housing Law, the Government's Decree on renovation, reconstruction of apartment buildings and ensuring apartment safety during the rainy and stormy season. Accordingly, the Provincial People's Committee requested project investors to strictly implement regulations on management and use of apartment buildings in accordance with the provisions of law. In particular, it is necessary to pay attention to organizing apartment building conferences to establish a management board; prepare and hand over apartment building records, hand over maintenance funds to the management board;...

Strengthen construction maintenance work according to the provisions of law; review and inspect and take measures to reinforce and brace common parts of old apartment buildings that are potentially unsafe in the event of natural disasters, storms and floods such as roofs, overhead water tanks, plaster ceilings, etc. to ensure absolute safety for people and property.

The Provincial People's Committee assigned the Vinh City People's Committee to regularly review and immediately implement solutions to relocate people from old, dangerous and degraded apartment buildings that must be demolished according to regulations, and arrange temporary accommodation for households that must be relocated to ensure the safety of people's lives and property.

It can be seen that the frustrations that people buying apartments in Vinh City are facing are preventable. It is important that state management agencies regularly review and inspect investors who are behind schedule in their projects; do not fulfill their financial obligations; owe taxes; lack legal procedures; do not promptly carry out procedures to issue red books to people after receiving the transfer. By strengthening inspection, detection, and strict handling of cases of law violations when not meeting the conditions for buying and selling apartments, even resolutely not allowing people to move in when not meeting the conditions, the risks of frustrations arising will be limited.
