Public opinion is paying much attention to the trial of Miss Truong Ho Phuong Nga (Miss Vietnam in the Russian Federation in 2007) and Nguyen Duc Thuy Dung, who were prosecuted for "Fraudulent appropriation of property" of over 16.5 billion VND from businessman Cao Toan My in Ho Chi Minh City.

Defendant, witness testified under duress?
It can be seen that in the past few days, there have been new witnesses and many new statements, with surprising details, even contradicting the indictment and case files. There is a suspicion of forced confession when lawyer Pham Cong Hung presented two statements of Miss Phuong Nga and Mr. Cao Toan My, which are identical down to the dots and commas. Testimony in court also showed that there was collusion, when defendant Thuy Dung was still able to write letters to the outside during the investigation and witness Lu Minh Nghia was still able to send letters to the defendant through a postman, an investigation officer named Nghia.
Another noteworthy information in the trial was that the defendant Thuy Dung and witness Lu Minh Nghia changed their testimony in court, saying that their previous statements to the investigation agency were not true. At that time, they were influenced and gave their statements under the guidance of others. Due to the seriousness of the above statements, the presiding judge asked them to commit to their statements and both of them confirmed that they would take responsibility for these statements.

Miss Phuong Nga stated that she did not trust anyone, so she kept her “right to remain silent” during the first days of the trial. However, on June 26, on the third day of the trial, this defendant suddenly stated: she and Mr. Cao Toan My did not have any agreement to buy and sell the house!
Another witness, Mr. Nguyen Van Yen, also revealed a surprising detail about the forgery of house purchase documents under the direction of Ms. Nguyen Mai Phuong - the person who is said to have created the house purchase documents in this case... After questioning the parties, the presiding judge stated that the forged house purchase documents were made after the victim filed a complaint with the investigation agency.

During today's trial (June 27), defendant Dung, witness Nghia, victim My and defendant Nga were questioned by the court.
An important piece of evidence related to the case was provided to the jury, which was the letters exchanged between defendant Thuy Dung and Lu Minh Nghia (Dung's lover) during the time Thuy Dung was detained.

During the interrogation, defendant Thuy Dung said the letters mainly talked about her mental instability and wondered why Nghia advised Dung to plead guilty and remedy the consequences for Mr. Cao Toan My. Meanwhile, My and Nga had a romantic relationship, not any other contract. In total, Dung sent Nghia about 10 letters on 5-7 occasions while the defendant was in detention.
Witness Lu Minh Nghia, who has related rights and obligations, said he received letters from Thuy Dung 5-7 times. The letters were handed over to the secretary by Mr. Nghia at the trial. However, this witness said that there were still some letters kept by Ms. Nguyen Mai Phuong. Explaining this, Nghia said that when he received Dung's letters, Nghia and Ms. Mai Phuong read them together, of which she kept about 4-5.
Mr. Lu Minh Nghia also stated that the reason he let Ms. Mai Phuong read the letter was because the officer who delivered Thuy Dung's letter was introduced by her, and she said that if there was anything, he would let her know. Mr. Nghia had met Ms. Mai Phuong at a coffee shop and a restaurant on Nguyen Trai Street, District 1 (HCMC).

The lawyer asked Nga about the so-called love contract with Mr. My, she said that was what the media called it. "In fact, it was an agreement when Mr. My gave the defendant money but did not trust him. He wanted the defendant to write it down in writing. For the defendant, this document is not important, but because Mr. My needed it, he made an agreement," Nga said.

The lawyer asked Phuong Nga about the first time Mr. My accused her of borrowing money to open a spa. Nga said: "That's true, but I didn't borrow money. I just told Mr. My about my desire to have a stable job. Mr. My is my lover, so I think he has the obligation to take care of me. Because our relationship is serious, not a service-receive-money relationship."
Thuy Dung denied receiving any of the 16.5 billion VND between Phuong Nga and Mr. Cao Toan My. Responding to the question of why in her self-declaration, Dung said she received 6.5 billion VND. Thuy Dung said: “The investigator made the defendant write it.”
According to the indictment of the People's Procuracy of Ho Chi Minh City, around July 2012, Phuong Nga told Mr. Cao Toan My (residing in District 7, Ho Chi Minh City) that she had many friends in the real estate industry who could buy a house at a price cheaper than the market price. Mr. My gave Nga 6 billion VND to buy a house in District 5, but Nga did not deliver the house. Then Nga told Mr. My that she had a house in District 1 worth 16.5 billion VND, this time Mr. My gave Nga 10.5 billion VND. After giving Nga a total of 16.5 billion VND but not receiving the house, Mr. My filed a complaint with the police. On September 21, 2016, Truong Ho Phuong Nga and Nguyen Duc Thuy Dung were brought to trial by the Ho Chi Minh City People's Court for the crime of Fraudulent Appropriation of Property. However, at the trial, Nga and Dung revealed a "love contract" like a sexual transaction between the beauty queen and "tycoon" Cao Toan My and claimed that Phuong Nga did not deceive Cao Toan My. Due to new details, the panel of judges returned the case file to reinvestigate the case. After the investigation was completed, the Ho Chi Minh City People's Procuracy still prosecuted Nga and Dung for the crime of Fraudulent Appropriation of Property. |
