The Vice Chairman of the People's Committee of Nghe An province held a regular monthly meeting with citizens in July.

On the afternoon of July 15th, authorized by the Chairman of the People's Committee of Nghe An province, Mr. Nguyen Van De - Vice Chairman of the People's Committee of the province - presided over the regular citizen reception session for July 2024.

Attendees included representatives from the Standing Committee of the Provincial People's Council, the Provincial Delegation of National Assembly Deputies, the Provincial Committee of the Vietnam Fatherland Front; representatives from Party committees, departments, agencies, and the city of Vinh and the district of Dien Chau.

Vice Chairman of the Provincial People's Committee Nguyen Van De received citizen Nguyen Sy Kien, residing in Hung Dung ward, Vinh City.

Mr. Kien petitioned the Vinh City People's Committee to grant his family land for the implementation of the Nguyen Phong Sac road upgrade and expansion project, in accordance with the Vinh City People's Committee's approval from 2011.

According to the case file, as part of the project to upgrade and expand Nguyen Phong Sac road, Mr. Kien's family had 128.17 square meters of land confiscated from their property.2land.

In December 2010, the Vinh City People's Committee approved the compensation and support plan for land clearance for Mr. Kien with a total amount of 1.617 billion VND; of which the compensation for land was 1.525 billion VND.

However, Mr. Kien disagreed and requested to be granted an exchange for the adjacent area of ​​60.5 square meters.2, which used to be a small, unused path.

The People's Committee of Vinh City agrees to exchange 60.5m.2The outstanding amount owed to Mr. Kien is nearly 720 million VND. However, to date, the plan to exchange land for Mr. Kien's family, specifically the 60.5 m² area, has not been approved by the Vinh City People's Committee.

According to the Department of Natural Resources and Environment, the Vinh City People's Committee has a policy to exchange 60.5m of land.2The land designated for transportation adjacent to Mr. Kien's plot does not comply with regulations; the reason is that the area to be reclaimed is residential land, while the area to be exchanged is transportation land, which has not been planned for residential purposes.

On the other hand, based on land law regulations, the aforementioned land exchange is not regulated; the recovery of a portion of residential land, while the remaining residential land is still suitable for habitation, does not fall under the cases eligible for land compensation as stipulated.

After hearing the opinions of Vinh City and relevant departments, Vice Chairman of the Provincial People's Committee Nguyen Van De instructed the Vinh City People's Committee to implement the compensation plan by allocating the 60.5 m² area.2The land adjacent to Mr. Nguyen Sy Kien's family's residential plot is in accordance with regulations; the deadline for implementation and reporting to the Provincial People's Committee and notifying citizens is before September 15, 2024.

Next, Vice Chairman of the Provincial People's Committee Nguyen Van De received citizen Nguyen Huu Thi, residing in Dien Doai commune, Dien Chau district.

Mr. Thi requested that the competent authorities properly implement Judgment No. 03/2014 of the Provincial People's Court, which obligates Mr. Ho Trong Quyen and Ms. Nguyen Thi Nhung (residing in Dien Doai commune) to return to Mr. Thi the right to use 405m².2Land and a single-story house.

According to a report from the Provincial Civil Enforcement Department, the enforcement officer organized verification, actively and proactively coordinated with local authorities on numerous occasions, worked with, analyzed, and persuaded Mr. Quyen and Ms. Nhung to voluntarily hand over their assets, but Mr. Quyen and Ms. Nhung's family still refused to comply.

To definitively resolve the case, the enforcement officer issued an enforcement order and organized one enforcement attempt, and also developed three enforcement plans, but all were unsuccessful. The reason was that during the enforcement process, they encountered fierce resistance from the person against whom the judgment was to be enforced and some other individuals.

After hearing the opinions of various departments and Dien Chau district, Vice Chairman of the Provincial People's Committee Nguyen Van De emphasized that all levels and sectors have been actively involved in the enforcement of the Provincial People's Court's judgment. However, due to strong resistance from the people, the enforcement of the judgment has not yet been carried out.

To definitively resolve the case, the Vice Chairman of the Provincial People's Committee assigned the Provincial Civil Enforcement Department to coordinate with the Provincial Police, Dien Chau District Police, Dien Chau District Enforcement Agency, and other relevant forces to develop a plan for enforcement and organize the enforcement in accordance with the law, ensuring the legitimate rights of citizens and maintaining political security and social order in the area.
