When is the consultation process for compensation, support, and resettlement plans when the State reclaims land for national defense and security purposes?

Reply:Based on the provisions of point a, clause 3, Article 87 of the 2024 Land Law as follows:

The sequence and procedures for compensation, support, resettlement, and land acquisition for national defense and security purposes; and socio-economic development for the national and public interest.

3. The procedures for preparing, appraising, and approving compensation, support, and resettlement plans are regulated as follows:

a. The unit or organization responsible for compensation, support, and resettlement shall prepare a compensation, support, and resettlement plan and coordinate with the People's Committee of the commune where the land is being acquired to publicly post the plan at the commune's People's Committee headquarters and at common gathering places in the residential area where the land is being acquired for a period of 30 days. Immediately after the public posting period ends, opinions on the compensation, support, and resettlement plan shall be solicited through direct meetings with residents in the area where the land is being acquired. If the landowner or property owner cannot attend the meeting for a valid reason, their opinions shall be submitted in writing.

Therefore, the compensation, support, and resettlement plan for land acquisition by the State for national defense and security purposes will be subject to public consultation immediately after the public posting period ends. This consultation will be conducted through direct meetings with residents in the area where the land is being acquired. If the landowner or property owner cannot attend the meeting for a valid reason, their opinions will be submitted in writing.
