On September 26th, the Provincial People's Court held a first-instance criminal trial to hear the cases of Tran Van Hai (born in 1977), residing in Moi Hamlet, Chau Loc Commune, Quy Hop District; Nguyen Van Huong (born in 1977), residing in Quy Hop Town, Quy Hop District, on charges of "Murder" and "Illegal possession of military weapons"; and Nguyen Dinh Trong (born in 1995), residing in Chau Quang Commune, Quy Hop District, on charges of "Resisting public officials".
At approximately 7 PM on January 22, 2015, Nguyen Van Huong and Tran Van Hai were driving two motorcycles carrying tin ore from Chau Hong to Quy Hop town. Upon reaching Chau Cuong commune, Hai's motorcycle collided with a motorcycle driven by Mr. Cong (a resident of Chau Cuong), causing Hai to fall to the ground. Hai cursed at Mr. Cong and slapped him twice. When Mr. Cong's friend intervened, Hai pulled out a gun and threatened him, causing the two men to flee.
Upon receiving the report, the Chau Cuong commune police arrived at the scene. There, Hai shot Mac Van Dung, the police officer on duty at Chau Cuong commune, in the chest before handing the gun to Huong. Dung was injured but still managed to subdue Huong, and she shot him once in the ear.
After shooting Dung, Huong and Hai fled. Nguyen Dinh Trong went to the scene and took Huong and Hai's car and the tin ore away, despite the local police's objections because it was evidence in the case.
The Forensic Examination Center of Nghe An province concluded that at the time of examination, Mr. Mac Van Dung's health damage was 1%. The Criminal Technical Department concluded that the gun used by Hai and Huong was a homemade revolver, firing 5.6x15.5mm ammunition. The gun is still usable and has similar capabilities to military weapons. The three bullets submitted for examination were sporting rounds. Using these bullets from the aforementioned gun could cause injury (death or serious injury) to a person.
Nguyen Van Huong and Tran Van Hai were prosecuted for the crimes of "murder" and "illegally possessing military weapons."
At the trial, Nguyen Van Huong and Tran Van Hai did not admit to the murder as charged in the indictment. However, based on the investigation findings, the victim's testimony, witness statements, and through questioning and public debate at the trial, the panel of judges concluded that the indictment of the two defendants for "murder" was correct and appropriate.
Considering the aggravating and mitigating circumstances, the court sentenced Tran Van Hai to 8 years in prison and Nguyen Van Huong to 7 years in prison for "murder". For the crime of "illegally possessing military weapons", Huong and Hai each received 1 year in prison. Nguyen Dinh Trong was sentenced to 6 months in prison for resisting a public official.
