Regulations on compensation when the State reclaims residential land.
Mr. NVT, residing in Nghi Loc district, asks: When the State reclaims residential land, which individuals, if they meet the conditions stipulated by regulations, are entitled to compensation for the land?
Article 98 of the 2024 Land Law stipulates:
1. Households, individuals, people of Vietnamese origin residing abroad, and economic organizations using residential land or owning houses attached to land use rights in Vietnam, when the State reclaims the land, if they meet the conditions for compensation stipulated in Article 95 of this Law, shall be compensated with residential land, or with houses, or with money, or with land for a different purpose than the reclaimed land.
2. Economic organizations, people of Vietnamese origin residing abroad, and economic organizations with foreign investment capital that are using land to implement housing construction investment projects, when the State reclaims the land, if they meet the conditions for compensation stipulated in Article 95 of this Law, shall be compensated in money or in land.
3. The Government shall provide detailed regulations for this Article.
