Regulations addressing the land use duration when the new Land Law comes into effect.

Article 258,The 2024 Land Law stipulates the resolution regarding the land use term when this Law comes into effect.as follows:

1. For land allocated by the State to economic organizations to generate capital for infrastructure construction projects, and land acquired through auctions before July 1, 2004, by economic organizations, the land use term shall be determined according to the term stated in the land allocation decision.

If the land allocation decision does not specify a time limit, the land use period shall be determined according to the time limit for that type of land as stipulated by law at the time of land allocation.

2. In cases where land has been allocated, leased, or its use rights recognized by the State, and the land use period has expired but the competent State agency has not yet reclaimed the land before the effective date of this Law, the extension of land use or land reclamation may be considered in accordance with the provisions of this Law.
