Rural residential land refers to land used by households and individuals in rural areas, including land for building houses, constructing facilities serving daily life, gardens, ponds, and plots of land within rural residential areas that conform to land use planning and rural residential area construction planning approved by competent State agencies.

Article 195The 2024 Land Law stipulates the following regarding residential land in rural areas:
1. Rural residential land is land used for housing and other purposes serving daily life within the same plot of land in a rural area.
2. Based on land availability and the actual situation of the locality, the Provincial People's Committee shall prescribe the land allocation limits for residential land to individuals in rural areas.
3. Residential land in rural areas must be allocated in conjunction with land used for the construction of public works and service facilities, ensuring convenience for people's production and lives, environmental sanitation, and in line with the modernization of rural areas.
4. The State has a policy of creating conditions for people living in rural areas to have housing by utilizing land in existing residential areas, limiting the expansion of residential areas on agricultural land.
